RESOLUTION NO. CC-10-16-00-01
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA
Introduction of Ordinances and Resolutions Required
Before Their Consideration By Council Committees
WHEREAS, Article I, Section 3 1 of the Constitution of Indiana grants all citizens of Indiana the
right to petition their government; and
WHEREAS, City Code Section 3-19(c) grants any citizen or other interested person the right to
address the Common Council at any scheduled Common Council meeting regarding any item of public
interest; and
WHEREAS, City Code Section 3-15 requires the Clerk-Treasurer to prepare a written agenda
before every Common Council meeting and to deliver a copy of same to the Mayor, each Common
Council member and the news media, so that the public and the Common Council are aware of all items
of public interest being considered at said meeting; and
WHEREAS, the Common Council has recently created eight (8) separate Council Committees
which generally meet one or more times each month as scheduled or as necessary; and
WHEREAS, there is frequently in attendance at Council Committee meetings enough Common
Council members to constitute a quorum of the Carreel Common Council; and
WHEREAS, at these Council Committee meetings, Common Council members consider matters
of public interest, including whether proposed ordinances and resolutions should be placed on the
Common Council agenda and discussed at a Common Council meeting, before such ordinances and
resolutions are introduced at a Common Council meeting or made known to the Mayor, the news media,
and all Common Council members; and
WHEREAS, no written agenda is prepared or distributed which identifies the subjects to be
considered at Council Committee meetings, making it impossible to determine whether or not one should
attend a Committee meeting and express his or her opinion on an issue being considered by the Council
Committee; and
WHEREAS, the above-described procedure is not sufficient to ensure that all matters of public
interest are openly and publicly discussed and that all of the City's elected representatives are required to
publicly vote on matters of public concern; and
WHEREAS, the Common Council wishes to ensure that all maters of public interest are publicly
discussed and decided.

NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
CARMEL, INDIANA, that all proposed Council ordinances and resolutions presented to the Clerk-
Treasurer be immediately placed upon the Common Council agenda for the Common Council's next
scheduled meeting and publicly introduced at such public meeting in conformance with Indiana law and
City Code Section 3-1.
BE IT FURTHER RESOLVED BY THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, that no proposed ordinance or resolution may be referred to or considered by any Council
Committee before it is placed on the agenda for and introduced at a scheduled and publicly noticed
Common Council meeting.
This Resolution shall take effect upon its passage by the Common Council, signing by the Mayor
and such publication as is required by law.
