CC-04-16-01-04 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL TO ACKNOWLEDGE AND SLrPPORT AN ADDITIONAL/SPECIAL APPROPRIATION OF FUNDS WHEREAS, the Park Joinder Agreement Under Interlocal Cooperation Act between the City of Cannel, Indiana, and the Trustee of Clay Township, Hamilton County, Indiana (the "Joinder Agreement"), provides that the Common Council of the City of Carmel, Indiana and the Township Board of Clay Township shall determine and provide the revenues necessary for the operation of the Carmel-Clay Board of Parks and Recreation (the "Board"), and the Carmel-Clay Department of Parks and Recreation (the "Department ") or for capital expenditures not covered by the issuance of bonds by a specific levy to be used exclusively for park and recreation purposes, a special appropriation or both; and WHEREAS, the City of Carmel has completed the purchase of, or is in the final stages of purchasing, the abandoned Monon railway corridor from 96th Street through 146th Street within Clay Township, Hamilton County, Indiana (the "Monon Corridor"); and WHEREAS, the Board has the responsibility to develop the Monon Corridor into a linear park, (the "Project"); and WHEREAS, the Board has passed and approved Resolution 4-10-01-01 at its regular April meeting, wherein it has requested that its fiscal bodies take all appropriate measures to appropriate Eight Hundred and Fourteen Thousand and no/100' s Dollars ($814,000.00) from the unappropriated cash balance of the Park Nonreverting Capital Fund 1215 (the "Unappropriated Balance"). WHEREAS, the Clay Township Trustee has reported that Eight Hundred and Fourteen Thousand and no/100's Dollars ($814,000.00) is available in the Unapproriated Balance for appropriation. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel that the Clay Township Board may, should it choose to do so, appropriate from the tinappropriated cash balance of the Park Nonreverting Capital Fund 1215, an amount not to exceed Eight Hundred and Fourteen Thousand and no/100's Dollars ($814,000.00) in accordance with Indiana law and the Joinder Agreement.
