Findings of Fact

BZA Hearing Officer
(V) Downes Pool Variances.
The applicant seeks the following development standards variance approvals:
Docket No. PZ-2021-00140 V UDO Section 2.06 Maximum 35% lot coverage
allowed,42% requested.
Docket No. PZ-2021-00141 V UDO Section 5.02.C.7 Pool setbacks: 3-ft from easement
and 10-ft side setback allowed,2-ft encroachment into easement and 5.5-ft side setback
requested. The site is located at 5058 St Charles Place It is zoned S2/Residence(Kingswood Subdivision
Lot 113). Filed by Carrie Ann & Paul Joseph Downes,owners.
Additional verbiage for Findings of Fact:
The lot coverage, utility easement and side yard setback requirements will not allow for a safe transition
from our screened porch into our pool area and sufficient space to walk between the pool and our house
and fence. In addition, we want to ensure the pool is aesthetically positioned in our yard for resale
value. Per the BZA report document distributed on Tuesday, August 17th, we have received approvals
from the Kingswood HOA,the City of Carmel Engineering Department, and the Planning
Department. In that same document, we also received a positive consideration from the Department of
Community Services. Denial of these variances will prohibit our ability to add a pool to our backyard and
make necessary improvements to a dilapidated backyard that have been planned since buying the property
in 2016.
DECISION
IT IS THEREFORE the decision of the CarmelBoard of Zoning Appeals Hearing Officer that Development Standards
Variance Docket Nos. PZ-2021-00140 V & PZ-2021-00141 V is granted, subject to any conditions stated in the
minutes of this Board,which are incorporated herein by reference and made a part hereof.
