HomeMy WebLinkAboutBPW-06-06-01-07 Utilities ExtendResolution BPW-06-06-01-07 RESOLUTION ESTABLISHING POLICY FOR EXTENSION OF CITY WATER AND SEWER SERVICE TO UNINCORPORATED SUBDIVISIONS WHEREAS, the City of Camel Board of Public Works and Safety ("Board") is responsible for the construction, custody, maintenance and improvement of City property and such structures as are needed for any public purpose, and for the City's collection, treatment and disposal of sewage; and, WHEREAS, the Board desires to establish a uniform policy for the extension of water and sewer service to unincorporated subdivisions located within the Cannel Utilities service area so as to better perform its above duties and responsibilities. NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Board of Public Works and Safety as follows: 1. The above recitals are incorporated herein by this reference. 2. The Policy For Water And Sewer Extensions To Unincorporated Sub-Divisions Within Cannel Utilities Service Area, attached hereto as Exhibit A, and incorporated herein by this reference (the "Policy") should be and is hereby adopted in its entirety by the Board. 3. The City Attomey is hereby directed to draft an ordinance that, in all material respects, incorporates this Policy, and to forward same to the Cannel Common Council for its consideration, approval and codification. C0 d , 2001, by a vote of ~ ayesand Onays. dBrain/~d, Presiding Office/~/~~r ate: Bi~alker, Member Date: ATT~ CITY OF CARMEL POLICY FOR WATER AND SANITARY SEWER EXTENSIONS TO UNICORPORATED SUB-DIVISIONS WITHIN CARMEL UTILITIES SERVICE AREA This policy is intended to cover water and sanitary sewer extensions for the following platted sub-divisions, and any other existing sub-divisions requesting sanitary sewer or water service that have not been annexed into the City of Carmel. Carmel Utilities shall provide each resident with a cost estimate that includes availability and connection fees, construction costs, engineering fees, legal fees, and easement/right of way costs. Annexation: Prior to advertising for construction bids, the sub-division must agree in writing to be annexed into the City of Cannel within three years after the start of construction. The annexation document shall be recorded with the sub-division plat. Each Resident must hook up to water and/or sanitary sewer no later than five years after construction is complete. Payment Terms: Each resident shall pay its' portion of the total project costs, including construction, engineering, legal, and any needed easement/right of way acquisitions that are needed. Each resident would be responsible for the cost of running his or her home lateral to the public line. Payments to Carmel Utilities may be made over 10 years at current market interest rates. However, if a resident hooks up in five years after construction, they would then have 5 years to pay the cost. Sanitary Sewer Example: If there are 50 homes and the total project costs are $300,000, each resident would owe $6,000 for project costs. Each resident would also pay availability and connection fees as stipulated in Carreel City Code. For a home with .50 acres these fees would total $1,477.50 which may also be paid over ten years. Therefore, residents would owe the Utility $7,477.50 that must be paid within 10 years after construction is complete. Each resident must sign a payment 6) 7) agreement prior to hook up that specifies the terms and amounts owed. Each payment agreement shall be recorded at the Hamilton County Court House. Individual Lots that are not part of a platted sub-division will automatically be annexed into the City of Carmel at the time of hook up to sewer and or water. Payment terms will be the same as above. Individual lots shall be charged applicable availability and connection fees as stipulated in Cannel City Code. Project costs for individual connections shall be determined on an individual case basis for individual lots that are not part of platted sub-divisions. In the event that a given property changes owners via a sale of the property, hook up and full payment must happen prior to the sale of the property.
