A RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF
CARMEL, 1NDIANA, ESTABLISHING A FACILITY USE POLICY
WHEREAS, the Mayor, as Executive Officer for the City of Carmel, Indiana, has the duty and
authority to exercise and perform all City duties that are executive or administrative in nature and to
ensure the efficient government of the City, pursuant to Indiana Code 36-4-4 and 36-4-5; and,
WHEREAS, the City of Carmel Board of Public Works and Safety has the duty and authority, as
an entity contained within the Executive Branch of City government, and pursuant to Indiana Code 36-4-4
and 36-9-6, to supervise, control and maintain all City buildings and property, including the City's
Gazebo, Fountain Area and City Hall; and
WHEREAS, in order to ensure the proper use, control and maintenance of City property, the
Board now desires to establish a formal policy for the use of City facilities by members of the public.
NO,V, THEREFORE, BE IT RESOLVED by the City of Carmel Board of Public Works and
Safety as follows:
1. The foregoing Recitals are incorporated herein by this reference.
The Facility Use Policy, Acknowledgement And Agreement form and Facility Use
Request Form attached hereto as Exhibits A, B and C, respectively, are hereby adopted and
shall become effective for any requested use of City facilities that is approved by this
Board on or after the date this Resolution is executed in accordance with law.

THE CITY OF CARMEL FACILITY USE POLICY
Carmel residents and organizations may use certain City of Carmel, Indiana ("City") facilities, primarily
the City's Gazebo, Fountain Area and City Hall, in accordance with this Facility Use Policy. Due to the
wide variety of events and activities for which the use of a City facility may be requested, the City, by and
through its Board of Public Works and Safety ("Board"), reserves the right to require additional terms
and conditions as circumstances dictate.
FACILITY USE REQUEST PROCEDURES
You must complete the attached Facility Use Request Form and Acknowledgement Agreement
and deliver them to the Board Secretary at the Office of the Clerk-Treasurer, Third Floor, Carmel
City Hall, at least one (1) month prior to the date of your event or activity. Approval of your
request must be granted by the Board, which meets on the first and third Wednesday of each
month. If you submit your request less than one (1) month prior to the date of your event or
activity, the Board may not have sufficient time to review your request.
No fee will be charged to use the City's Gazebo, Fountain Area or City Hall.
A refundable security deposit of One Hundred Dollars ($100.00), in the form of a certified check
or money order made payable to the "City of Carmel", must be submitted with your completed
Facility Use Request Form and Acknowledgement And Agreement form. This security deposit will
be used to pay for any consequential clean-up, repairs, damages and/or utility costs resulting
from your use of a City facility. You remain liable for all costs and damages which exceed the
amount of your security deposit. Your security deposit will be refunded to the extent it is not used
to pay for repairs, costs or clean-up associated with your use of a City facility.
GENERAL TERMS AND CONDITIONS OF FACILITY USE
The use of a City facility for a City-sponsored function shall take priority over its use for all other
purposes, even if prior approval for another purpose has been obtained. In addition, an annual
or ongoing event shall be given preference over a one-time event. Otherwise, all requests will be
granted on a first-come, first-served basis. Requests may be submitted to the Board up to twelve
(12) months in advance of the activity or event date.
The requested use of a City facility must conform with the design and intended function of the
facility, must comply with all applicable Federal, state and local laws and must not be injurious to
the public health, safety or general welfare.
You shall immediately clean up the City facility at the conclusion of your event or activity, and
restore the facility to the condition it was in immediately prior to your use.
You may not charge an admission fee for your activity or event without prior Board approval.
Voluntary donations may be solicited.

ACKNOWLEDGEMENT AND AGREEMENT
TO COMPLY WITH CITY FACILITY USE POLICY
I have read and understand the City of Carmel, Indiana ("City") Facility Use Policy and agree to be bound by
all the terms and conditions set forth therein.
I will leave the City facility I use in the same condition than it was immediately prior to my use thereof. I
agree to pay for any damage, repair or clean-up costs incurred by the City as a result of my use of a City
facility.
I hereby certify that I, and the organization I represent, if applicable, agree to be bound by the City's Facility
Use Policy and by any additional conditions or restrictions placed upon my/our use of a City facility by the
Board. I understand that the Board has the right to deny or revoke my request for the use of a City facility
for any lawful reason, and that the City, the Board, and their respective officers, officials, employees and
agents, will incur no liability and will be held harmless by me and/or my organization from any damages,
costs or expenses incurred directly or indirectly as a result of such action.
