CC-06-17-02-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, RATIFYING ACTION TAKEN BY THE CITY OF CARMEL BOARD OF PUBLIC WORKS AND SAFETY AND APPROVING THE CONTRACTS FOR FIRE PROTECTION BETWEEN THE CITY OF CARMEL AND CLAY TOWNSHIP WHEREAS, since 1927, the City of Carmel, Indiana ("City") and Clay Township, Hamilton County, Indiana ("Township") have cooperated on the provision of firefighting services and equipment; and WHEREAS, it is the desire of the Common Council of the City of Carmel ("Council") to continue this cooperation; and WHEREAS, the City and the Township derive their legal authority for such cooperation from Indiana Code 36-1-7-1 et seq., otherwise known as the Interlocal Cooperation Statute; and WHEREAS, pursuant to Indiana Code 36-1-7-4 any agreement made between Indiana political subdivisions must be approved by the fiscal body of each party either before or after it is entered into by the executives of the parties or be approved by the Attorney General of Indiana; and WHEREAS, for the past several years, the Contract for Fire Protection Between the City of Carmel, Indiana, And Clay Township Of Hamilton County ("Contract"), including the Contract for 2002, have been approved by the fiscal body of the Township and the Board of Public Works and Safety of the City; and WHEREAS, the Board of Public Works and Safety is not the fiscal body of the City; and WHEREAS, the Council is the fiscal body of the City; and WHEREAS, the City and the Township have previously correctly entered into interlocal cooperation agreements for other matters, such as the financing, construction, and maintenance of fire stations by following the appropriate statutorily required procedures; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, that: Section 1: The 2002 Contract For Fire Protection Between The City Of Carmel, Indiana, And Clay Township Of Hamilton County is hereby approved. Section 2: The actions taken by the Board of Public Works and Safety on Mamh 25, 2002 are hereby ratified. Sponsored By: Councilor Koven Section 3: All previous Contracts for Fire Protection Between The CitY Of Carmel, Indiana And Clay Township Of Hamilton County are hereby approved. Section 4: The appropriate City officials are hereby instructed to obtain the approval of the Council for all future Contracts for Fire Protection, so long as such approval is required by the Interlocal Cooperation Statute.
