A RESOLUTION OF THE COMMON COUNCIL OF
THE CITY OF CARMEL, INDIANA, ESTABLISHING A CELLULAR
TELEPHONE POLICY FOR CITY COUNCIL MEMBERS
WHEREAS, the City of Carmel provides cellular telephone service to the members of the
Common Council for the benefit of the members and their constituents;
WHEREAS, the Common Council of the City of Carmel wants to take the necessary
precautions to assure that this service is properly accounted for; and
WHEREAS, the Connnon Council of the City of Carmel desires to adopt a Cellular
Telephone Policy for the members of the Common Council;
NOW, THEREFORE, Be It Resolved by the Common Council of the City of Carmel,
Indiana, as follows:
Section I: This Resolution hereby establishes a Cellular Telephone Policy applicable
only to the members of the Council.
Section II: Cellular telephone service provided by the City for members of the Council
shall be used to maximize the accessibility of the members of the Council to their constituents,
City staff, and each other.
Section III: The President Pro Tempore of the Common Council or his or her designee
shall obtain the most appropriate cellular telephone service plan based upon the needs and usage
history of the users of the service. This plan may be for an annual term or for any other term so
long as the agreement contains language providing for termination due to lack of appropriation.
Section iV: If the plan selected is a flat rate for a certain amount of minutes of service
and that rate is charged regardless of whether the minutes are utilized then the individual
member of the Council is personally responsible for paying directly or for reimbursing the City
for all costs resulting from usage exceeding that allowed by the flat rate. Council members shall
be advised of such excess charges on a quarterly basis.
Section V: Any member of the Council leaving office as a member of the Council, for
any reason, is responsible for returning any mobile telephone equipment in his or her possession
to the Clerk-Treasurer by the end of his or her last day in office as a member of the Council and
for paying directly or reimbursing the City for all mobile telephone costs which occurred during
his or her last month as a member of the Council for which he or she would have been
responsible had he or she remained a member of the Council.
Section VI: Any member of the Council leaving office as a member of the Council is
entitled to maintain the cellular telephone number assigned to him or her as a Council member in
the event he or she continues to personally contract for cellular telephone service from the same
provider as that utilized by the Council at the time of his or her departure.

Section VII: This Resolution shall be in full force and effect from and after its passage
and signing by the Mayor.
