RESOLUTION NO. CC-10-07-02-04
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
REGARDING PURCHASE OF PROPERTY BY CARMEL-CLAY
PARK AND RECREATION BOARD
WHEREAS, Clay Township of Hamilton County, Indiana (the "Township"), entered into a
Joinder Agreement with the City of Carmel, Indiana (the "City"), dated July 26, 2002 (the "Joinder
Agreement") to provide park and recreation services jointly throughout the City and Township; and
WHEREAS, pursuant to the Joinder Agreement, a joint Carmel-Clay Park and Recreation Board
(the "Park Board") has been established; and
WHEREAS, the City purchased three (3) contiguous parcels of real property consisting of
approximately 27.7 acres, as are more particularly described in Exhibit "A" attached hereto (the
"Property"), for the purpose of widening 116th Street and locating a potential street maintenance facility
thereon; and
WHEREAS, the Park Board has identified the Property as being suitable for acquisition by the
Park Board for park and recreation purposes; and
WHEREAS, pursuant to I.C. 36-1-10.5-5 and the Joinder Agreement, it is advisable that the
Carmel Common Council pass a resolution indicating its interest in selling the Property to the Park Board
prior to the Park Board seeking appraisals of the Property in order to consider its purchase; and
WHEREAS, the Carmel Common Council desires to express its interest in the Park Board's
purchase of all or a portion of the Property, and to thereby facilitate the Park Board's consideration of the
purchase of same;
NOW, THEREFORE, BE IT RESOLVED that, in accordance with the provisions of I.C. 36-1-
10.5-5(1) and the Joinder Agreement, the Carmel Common Council hereby expresses its interest in the
Park Board's purchase of the Property, or a portion thereof, for park and recreation purposes, and for the
Park Board to take such actions as are reasonably necessary to investigate the acquisition of the Property
by the Park Board.
