RESOLUTION NO. CC-07-21-03-01
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
REGARDING SATISFACTION OF BONDING REQUIREMENTS
WHEREAS, on June 16, 2003, the Carmel Common Council passed its Resolution No. CC-06-
16-03-02 ("Resolution"), thc satisfaction of bonding requirements for persons who will handle money on
the City's behalf pursuant to that certain Park Joinder Agreement between the City of Carmel, Indiana and
the Township of Clay, Hamilton County, Indiana, ("Joinder Agreement"); and
WHEREAS, subsequent to the passage of the Resolution, the Clay Township Trustee requested
changes to the language contained therein to reflect the fact that it will be Parks Department officers and
employees, rather than City officers and employees as referenced in the Resolution, who will be handling
money under the Joinder Agreement and who will need to be bonded. These changes are reflected in this
resolution; and
WHEREAS, Section 6.6 of the Joinder Agreement requires each officer and employee who
handles money in the performance of their duties thereunder to be bonded; and
WHEREAS, pursuant to Indiana Code 5-4-1-18(b), the Common Council of the City of Carmel,
Indiana, may authorize the purchase of a blanket bond to cover all of the officers and employees of the
Carmel/Clay Parks Department who will handle money in the performance of their duties on the City's
behalf under the Joinder Agreement, including those persons who would otherwise be required to file an
individual bond; and
WHEREAS, it is prudent and economical for the City of Carmel, Indiana, to authorize the
Carmel/Clay Board of Parks and Recreation (the "Parks Board") to obtain such a blanket bond to cover
those officers and employees of the Cannel/Clay Parks Department who will handle money on the City's
behalf in the performance of their duties under the Joinder Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel,
Indiana, that the Park Board may satisfy the bonding requirements of Section 6.6 of the Joinder
Agreement by obtaining and maintaining in full force and effect for the term of the Joinder Agreement a
blanket bond covering all Carmel/Clay Parks Department officers and employees who will handle money
on the City's behalf in the performance of their duties under the Joinder Agreement.
NOW, THEREFORE, BE IT FURTHER RESOLVED THAT, Common Council Resolution
No. CC-06-16-03-02 shall be and the same is hereby REPEALED as of the effective date and time of this
Resolution.
