At the meeting held March 2, 2004 the Special Studies Committee took the following action regarding the Architectural
Design, Lighting and Signage Amendment (ADLS Amend) approval for the property located at 10222 North Michigan
Road.
APPROVED: Docket No. 04020009 ADLS Amend. The Committee approved the request three (3) in favor zero (0)
opposed thereby granting the petition with the following conditions:
1. Move sign to acceptable location outside right-of-way.
2. Complete fence and landscaping prior to sign permit issuance.
In order to assist the Department's review, please attach a copy of this letter when making application for permits
regarding the improvements contained within this approval.

APPROVED: Docket No. 04020009 ADLS Amend. The Committee approved the request three (3) in favor zero (0)
opposed thereby granting the petition with the following conditions:
1. Move sign to acceptable location outside right-of-way.
2. Complete fence and landscaping prior -to sign permit issuance.

Attached, you will find a Landscaping Plan for Nations Rent — located at 10222 N.
Michigan Road. The Carmel Plan Commission Special Studies Committee approved this
landscaping plan on September 3, 2002 — please see the attached minutes for Docket #
110-02 ADLS Amend.
On March 2, 2004, Nations Rent was before the Carmel Plan Commission Special
Studies committee with Docket #04020009 ADLS Amend for a ground sign. This sign
was approved, however, there was the condition that the fence and landscaping from the
previous docket, 110-02 ADLS Amend, must be complete prior to a sign permit
application being issued for the ground sign.
I have recently received this sign permit application, and Jon Dobosiewicz has asked me,
to either have you or Daren do a site inspection at 10222 N. Michigan Road to verify that
this landscaping is in place and a fence has been installed. Once this site inspection has
been done, could you please advise me if I should go ahead and release the sign permit
for Nations Rent.
I appreciate all of your help in this matter, thanks so much.

Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage
approval to install a new fence and landscaping materials. The site is located at 10222
North Michigan Road. The site is zoned I-1/Industrial and is within the US
421/Michigan Road Overlay.

Arvin Carpenter of Miller Surveying, Noblesville, appeared before the Committee along with Ed
Coverdale, owner of the property.
The State of Indiana is taking additional right-of-way in front of Nations Rent at 10222 North
Michigan Road. The location of the existing entrance will be changed from the south side of the
property to the north side. The existing fence and drive will have to be replaced. The new fence
will be a six-foot, chain link security fence. The landscaping will be set back 36 feet from the
new right-of-way and the landscaping will be in front of the chain link fence. A new driveway
will be installed together with new gates.
Laurence Lillig for the Department: This application is brought forward due to the right-of-way
improvements the State of Indiana is making along Michigan Road. Two aspects of the plan are
to be reviewed by the Committee, the landscaping and the re -location of the fence along
Michigan Road. The Department is recommending favorable consideration of those aspects of
the plan. However, there is a question regarding signage on this site. Nations Rent has been
located on this site for over two years and permanent signage is yet to be established. From time
to time, banners have been posted on the fence or the front fagade of the building. The
Department would like to know when permanent signage will be established so that the constant
stream of banners can be eliminated.
Ed Coverdale, Noblesville, Indiana addressed the Committee as property owner of Nations Rent.
Mr. Coverdale reported that signage is the tenant's responsibility and Nations Rent should be
applying for sign permits.
Sherry Marchbanks, A Sign by Design, said they have been working with Nations Rent on
signage and they were hopeful of making formal application for signage as soon as the Michigan
Road improvements are completed in this area.

approval to install a new sign. The site is located at 11590 North Meridian Street. The
site is zoned B-6 Business and is within the US 3I/Meridian Street Overlay.

Sherry Marchbanks of A Sign by Design, 5008 West 96`h Street, Indianapolis, appeared before
the Committee on behalf of Midwest Sleep Institute. Midwest Sleep Institute is re -locating to the
former Morgan Guaranty location.
The sign will be reverse -channel illumination; it is over 75 feet in the air and set back more than
300 feet. The sign will be made of titanium with brushed brass, satin finish so that it will look
and stay bright during the day. The sign will not tarnish and is very low maintenance. The sign
will be 100 square feet on one end of the building —the only sign on the building, and will face
U.S. 31 (east). There will be NO logo on the sign.

Bob Olson and Ross Lally, CSO Engineers, 280 East 96`h Street, Indianapolis appeared before
the Committee representing Midwest ISO Corporation, located at 701 City Center Drive. The
current proposal is to install an enclosure for two transformers. The structure will be 50 feet
long, 25 feet wide and approximately 12 feet high.
The architectural detail of the enclosure matches the existing building. Access to the new
enclosure will be on the east -side of the building, and once the new street is installed, the access
will not be visible. The new structure will be located directly south of the existing.

The proposal is for a single ground sign, 32 square feet, with landscaping around the base. The
sign is black on gold and drawings have been submitted.
Jon Dobosiewicz stated that last year, approval was granted for an ADLS Amendment and the
State required additional right-of-way at this location for the intersection in front of the Super -
Target. That plan was approved and has yet to be completed, including a fence and additional
landscaping approved along the frontage. Any approval and granting of a sign permit should be
conditioned upon completion of the agreed improvements.
There was discussion regarding the timing of the landscape plantings —last fall was ideal. Also,
drawings submitted to the Department show the sign as being within the right-of-way. The sign
must not be placed within the right-of-way but can be within the 10 feet outside the right-of-way.
Mark Rattermann moved for approval of Docket No. 04020009 ADLS Amend, Nations Rent
(Michigan Road) subject to the completion of the landscaping and fencing improvements by
the owner as previously required by the State, seconded by Madeleine Torres and APPROVED
3-0.
6. Docket No. 04020007 ADLS Amend: Citgo - Batteries Plus: ADLS Amendment
The applicant seeks approval for two signs. The site is located at the southeast corner of

Batteries Plus is in process of changing their corporate colors at all locations throughout the U.S.
The colors are two different shades of green.
Mr. Morgan stated a concern with the colors of green matching the existing on the band. At
some point, the colors of panels would be changed so that the colors would blend together, or as
shown, change the color to white and keep the corporate colors.

Attached, you will find a Landscaping Plan for Nations Rent — located at 10222 N.
Michigan Road. The Carmel Plan Commission Special Studies Committee approved this
landscaping plan on September 3, 2002 — please see the attached minutes for Docket #
110-02 ADLS Amend.
On March 2, 2004, Nations Rent was before the Carmel Plan Commission Special
Studies committee with Docket #04020009 ADLS Amend for a ground sign. This sign
was approved, however, there was the condition that the fence and landscaping from the
previous docket, 110-02 ADLS Amend, must be complete prior to a sign permit
application being issued for the ground sign.
I have recently received this sign permit application, and Jon Dobosiewicz has asked me,
to either have you or Daren do a site inspection at 10222 N. Michigan Road to verify that
this landscaping is in place and a fence has been installed. Once this site inspection has
been done, could you please advise me if I should go ahead and release the sign permit
for Nations Rent.

The regularly scheduled meeting of the Special Study Committee met on September 3, 2002 at
7:00 PM in the Caucus Rooms of City Hall, Carmel, Indiana.
Members present were: Leo Dierckman, Chairperson; Jerry Chomanczuk; Nick Kestner; Pat
Rice; and Paul Spranger.
Laurence Lillig was in attendance representing the Department of Community Services. Code
Enforcement Officer Adrienne Keeling was also present.
1. Docket No. 100-02 ADLS Amend- Carmel Walk Shopping Center
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping &
Signage approval granted for a retail shopping center. The site is located at 1305 South
Range Line Road. The site is zoned B-8Business.

2. Docket No. 102-02 ADLS Amend- Allstate
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping &

Teresa Bartlett of Express Graphics was present representing the applicant. Revised drawings of
the signage were distributed. The proposal is no longer for a multi -tenant building; the premises
will be occupied solely by Allstate Insurance.
Allstate insists the sign carry their corporate colors on the face of the sign - blue and white. The
proposed sign is less than allowed by the Sign Ordinance.
Department Report, Laurence Lillig. Given the design presented this evening and as long as the
Committee's issues are addressed, the Department is recommending favorable consideration of
the design.
Paul Spranger was complimentary of the sign and the redwood. The proposal is an improvement

Jerry Chomanczuk asked the distance from the sidewalk to the sign - petitioner responded 15 feet

in the revised drawing dated September 2, 2002 and submitted this evening to the Committee.
The motion was seconded by Jerry Chomanczuk and APPROVED 5-0.
3. Docket No. 101-02 ADLS Amend- Tharp Convenience Center
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping &
Signage approval to modify the signage for a retail shopping center. The site is located at
808 West Main Street. The site is zoned OM -SF / Old Meridian -Single Family.

Mike Worrell of Worrell Petroleum, Anderson, Indiana appeared before the Committee along
with Bill Simmons owner of the Marathon store. Worrell Petroleum operates the Marathon
station at the corner of the Silver Convenience Center located at 808 West Main Street.
Bill Simmons, owner of the Marathon Station, (leases the gas station from Don Tharp) said the
face of the sign was changed - there is no sign on the store structure, just the ground sign. Mike
Worrell distributed drawings of the sign, both existing and with the changes. The owner has
applied for graphics as well as the sign change.
Note: For ease and simplicity, the Marathon Station will be referred to as 101-02a ADLS
Amend the strip center will be referred to as 101-02b ADLS Amend.
Department Report, Laurence Lillig: The Marathon Station is allowed a total of two signs - the
ground sign and one on the canopy OR two ground signs OR two wall signs, any combination.
However, the canopy itself would only be allowed ONE sign. The sign background is aluminum
fascia, covered with vinyl, and "Marathon" still exists under the vinyl. The Department would
like to see "Marathon" painted over rather than covered with vinyl. It is also preferable to have
the blue band continued where the "Marathon" text would have been so that "Marathon" is only
on one side of the canopy and the blue band continuous on the other three sides. The ground sign
is essentially a box sign supported on two metal bases. The base should be a solid brick rather
than exposed columns at the base. Also, pennants and banners are prohibited under the Sign
Ordinance.
Paul Spranger noted the illumination has increased. The lighting is in excess during the hours of
operation. Mr. Worrell said new bulbs were installed —they are 400 Watts. Paul Spranger
suggested the petitioner convert to 300 Watts rather than 400 Watts; it would be more in keeping
with the area. Also, there was discussion regarding the installation of reflectors in order to
reduce the level of illumination. Mike Worrell agreed to install directional reflectors within the
next 30 days.

Paul Spranger moved for approval of 101-02a ADLS Amend (Marathon Station) with the
following conditions: 1) The canopy will be amended as committed by the applicant to extend
the blue band in the same materials as existing. 2) Reflectors will be installed for all under -
canopy lighting, 300 Watts. 3) The existing ground sign will have an appropriate brick base and
will be subject to the approval of the Department. The motion was seconded by Jerry
Chomanczuk and APPROVED 5-0.
Note: The petitioner will need to apply for sign permits.
Docket No. 101-02b ADLS Amend, Tharp Convenience Center
Mark Keen of Sign Fab, 6468 Rucker Road, Indianapolis appeared before the Committee
representing Don Tharp for the Tharp Convenience Center at 808 West Main Street. The sign
panels are baked -on acrylic white. The petitioner is requesting signage of individual letters on a
"raceway." Currently, there is red copy on all of the signs (red neon) and these can be changed.
Mr. Keen distributed pictures of the prior signage—before and after. Permits were applied for
but never approved for the signs.
Regarding the lighting, Mr. Keen said he had spoken with Don Tharp and he is willing to do
whatever the Commission requires.
Department Report, Laurence Lillig. As long as the Committee's comments and concerns are
addressed, the Department recommends favorable consideration.
Leo Dierckman commented the canopy looks good, the white is good —the letters are the issue.
Paul Spranger said the signage needs to be consistent. Also, the drop -down lights need to be
recessed. The actual signage now has a 3-dimensional effect and the level of internal
illumination is excessive.
Mr. Keen reported all of the signs have the same letter height; the signs are 9 feet long.
Currently, there are two signs existing and they are red, the only other color is a green band
below McBeth's. The level of illumination on the signs is not excessively bright. There is a
maximum of four tenants in the Center. Kinder Care has the largest space; all signs will be the
same letter height.
Laurence Lillig stated that in the petitioner's application for signage, the dimensions of each sign
are stated as being 18 inches by 9 feet or 13.5 square feet. In the same application, the square
footage of each sign is noted as approximately 22 square feet - a large discrepancy. The total
height of each sign is listed at 22 inches.
Mr. Keen said the white band is 22 inches clearance from top to bottom. The signs should be 16
inches tall by a maximum of 9 feet wide, even for Kinder Care. (12 square feet per sign) As
tenants change, the signs will be replaced with black, reverse -channel letters. Mr. Keen will
remove the green band on the McBeth's sign and replace with black, white copy - no red.

Nick Kestner requested the petitioner either use the same type face or the same color, otherwise it
becomes a hodge-podge.
Pat Rice moved for approval of 101-02b ADLS Amend, Tharp Convenience Center, with the
following conditions: 1) Signs will be black, reverse -channel letters, 2) 16-inch sign height, 3) 9-
foot sign width, 4) logos may be internally illuminated. 5) The two existing red signs will be
allowed to remain but will be flush -mounted. 6) The green band will be eliminated from the
McBeth's sign and 7) the lighting will be recessed. As tenants change, tenant signage will be
black, reverse -channel letters. The motion was seconded by Jerry Chomanczuk and
APPROVED 5-0.
4. Docket No. 110-02 ADLS Amend - Nations Rent
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage
approval to install a new fence and landscaping materials. The site is located at 10222
North Michigan Road. The site is zoned I-1/Industrial and is within the US
421/Michigan Road Overlay.

Arvin Carpenter of Miller Surveying, Noblesville, appeared before the Committee along with Ed
Coverdale, owner of the property.
The State of Indiana is taking additional right-of-way in front of Nations Rent at 10222 North
Michigan Road. The location of the existing entrance will be changed from the south side of the
property to the north side. The existing fence and drive will have to be replaced. The new fence
will be a six-foot, chain link security fence. The landscaping will be set back 36 feet from the
new right-of-way and the landscaping will be in front of the chain link fence. A new driveway
will be installed together with new gates.
Laurence Lillig for the Department: This application is brought forward due to the right-of-way
improvements the State of Indiana is making along Michigan Road. Two aspects of the plan are
to be reviewed by the Committee, the landscaping and the re -location of the fence along
Michigan Road. The Department is recommending favorable consideration of those aspects of
the plan. However, there is a question regarding signage on this site. Nations Rent has been
located on this site for over two years and permanent signage is yet to be established. From time
to time, banners have been posted on the fence or the front fagade of the building. The
Department would like to know when permanent signage will be established so that the constant
stream of banners can be eliminated.
Ed Coverdale, Noblesville, Indiana addressed the Committee as property owner of Nations Rent.
Mr. Coverdale reported that signage is the tenant's responsibility and Nations Rent should be
applying for sign permits.
Sherry Marchbanks, A Sign by Design, said they have been working with Nations Rent on
signage and they were hopeful of making formal application for signage as soon as the Michigan
Road improvements are completed in this area.

5. Docket No. 117-02 ADLS Amend - Fidelity Plaza - Midwest Sleep Institute
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage
approval to install a new sign. The site is located at 11590 North Meridian Street. The
site is zoned B-6 Business and is within the US 3l/Meridian Street Overlay.

Sherry Marchbanks of A Sign by Design, 5008 West 96th Street, Indianapolis, appeared before
the Committee on behalf of Midwest Sleep Institute. Midwest Sleep Institute is re -locating to the
former Morgan Guaranty location.
The sign will be reverse -channel illumination; it is over 75 feet in the air and set back more than
300 feet. The sign will be made of titanium with brushed brass, satin finish so that it will look
and stay bright during the day. The sign will not tarnish and is very low maintenance. The sign
will be 100 square feet on one end of the building —the only sign on the building, and will face
U.S. 31 (east). There will be NO logo on the sign.
Laurence Lillig reported for the Department. A favorable consideration is being recommended
once the Committee's concerns and comments have been addressed.
Nick Kestner moved for approval of Docket No. 117-02 ADLS Amend, Fidelity Plaza -
Midwest Sleep Institute. The motion was seconded by Paul Spranger and APPROVED 5-0.
6. Docket No. 118-02 ADLS Amend - Carmel Science & Technology Park, Block 7, Lot
1 - MISO Corporate Headquarters
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage
approval to install an AC unit enclosure. The site is located at 701 City Center Drive.
The site is zoned M-3/Manufacturing.

Bob Olson and Ross Lally, CSO Engineers, 280 East 96th Street, Indianapolis appeared before
the Committee representing Midwest ISO Corporation, located at 701 City Center Drive. The
current proposal is to install an enclosure for two transformers. The structure will be 50 feet
long, 25 feet wide and approximately 12 feet high.
The architectural detail of the enclosure matches the existing building. Access to the new
enclosure will be on the east -side of the building, and once the new street is installed, the access
will not be visible. The new structure will be located directly south of the existing.
Laurence Lillig reported for the Department. The ground sign on Guilford has no sign permit.
Once the Committee's comments and concerns have been addressed, the Department
recommends favorable consideration.

In response to questions from Jerry Chomanczuk, Ross Lally said there is no noise abatement
issue the units are actually small condensers with small fans —no compressors or loud noise -
making equipment. The units would only function on standby and in the case of a power outage.
Paul Spranger moved for approval of Docket No. 118-02 ADLS Amend, Carmel Science &
Technology park, Block 7, Lot 1 - MISO Corporate Headquarters, as presented and
amended by petitioner. The motion was seconded by Jerry Chomanczuk and APPROVED 5-0.
