THE ANNEXATION OF LAND INTO THE TOWN OF FISHERS
WHEREAS, R & P Enterprises, Inc., d/b/a R.P. Milhouse,
and Margaret T. Muller petitioned the Board of Trustees of the
Town of Fishers to annex approximately 151.6 acres of real estate
located in Hamilton County, Indiana, into the Town of Fishers,
said real estate being more particularly described in the attached
Exhibit A (the "Real Estate"); and
WHEREAS, I.C. 36~4-3-9 provides that a town must
the consent of the legislative body of a second - or third
obtain
class city for annexing territory within three (3) miles of
the corporate boundaries of the City; and
WHEREAS, the Real Estate is within three (3) miles of the
corporate boundaries of the City of Carmel; and
WHEREAS, the consent of the Carmel Common Council is required
to annex the Real Estate into the Town of Fishers pursuant to
the aforementioned statute; and
WHEREAS, the Carmel Common

NOW, THEREFORE, the Carmel Common Council, properly convened
any required notice of such meeting having been duly given,
hereby consents to and approves the annexation of the Real Estate
as further described in Exhibit A attached hereto and made a
part hereof into the Town of Fishers, Hamilton County, Indiana.
This Resolution shall be in full force and effect from
and after its passage and execution by the Mayor.
