HomeMy WebLinkAboutBPW-10-15-03-08 Workers Comp/KincaidRESOLUTION BPW-10-15-03-08 A RESOLUTION PERMITTING THE CITY OF CARMEL TO PAY EMPLOYEE ROBBIE L. KINKEAD THE DIFFERENCE BETWEEN HIS WORKER'S COMPENSATION PAYMENTS AND HIS NORMAL TAKE-HOME PAY, IN ACCORDANCE WITH SEC. 2-52 OF CARMEL CITY CODE WHEREAS, the City of Carmel purchases Worker's Compensation insurance to compensate for work time lost due to workplace injuries; and WHEREAS, Worker's Compensation insurance pays only 66-2/3% of an employee's weekly gross wages; and WHEREAS, Sec. 2-52 of Carmel City Code authorizes the Board of Public Works and Safety to supplement an individual's Worker's Compensation payments to permit the employee to receive his or her normal "take-home pay"; and WHEREAS, Robbie L. Kinkead of the Carmel Utilities Department sustained a serious leg injury while working for the City, and will be unable to work for at least six (6) weeks following surgery on September 25, 2003. NOW, THEREFORE, BE IT RESOLVED by the Carmel Board of Public Works and Safety as follows: For that period during which employee Robbie L. Kinkead receives Worker's Compensation payments for loss of wages due to surgery performed on September 25, 2003, the City shall pay Mr. Kinkead the difference between his weekly Worker's Compensation payments and his normal weekly net pay (based on 37.5 hours of work at his current hourly rate). Supplemental payments shall be made on a bi-weekly basis, and shall cease when Mr. Kinkead's Worker's Compensation benefits for loss of wares cease. The salary supplements paid by the City to Mr. Kinkead shall not extend beyond November 7, 2003, unless an extension is approved by the Board of Public Works and Safety.
