A RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY
OF THE CITY OF CARMEL, INDIANA,
REGARDING THE SALE OF REAL PROPERTY
WHEREAS, the City of Carmel, Indiana (hereinatler, the "City"), owns certain property located
at the northeast comer of West Main Street and First Avenue NW in Carmel, Indiana, such property being
more specifically described in the attached Exhibit A incorporated herein by reference (the "Property");
and
WHEREAS, the Property is in a part of Carmel Old Town which is in the midst of a significant
redevelopment and revitalization project; and
WHEREAS, the Property has previously been used for public parking; and
WHEREAS, there is no further need for the Property to be used for public parking or for any
other public purpose; and
WHEREAS, the Property was not acquired through eminent domain proceedings; and
WHEREAS, the Property has been appraised as required by Indiana Code ("I.C.") 36-1-11-4.2;
and
WHEREAS, the appraised value of the Property is such that investing significant resources in the
sale of the Property would not be prudent; and
WHEREAS, as part of the redevelopment and revitalization of Carmel Old Town, certain
commemial and retail uses have been identified as desirable and appropriate; and
WHEREAS, the use of the Property as an art gallery would facilitate appropriate and compatible
land use planning for that part of Cam~el Old Town in which the Property is located; and
WHEREAS, the use of the Property as an art gallery would promote economic development in,
and the redevelopment and revitalization of, Carmel Old Town.
NOW, THEREFORE, BE IT RESOLVED that, in accordance with the provisions of I.C. 36-1-
11-4.2, the City of Carmel Board of Public Works and Safety hereby approves of and recommends the
sale of the Property as described herein, subject to the following terms:

1. The Property shall be sold for the purposes of constructing and operating an art gallery.

2. The sale of the Property shall be conditioned upon the City's review and approval of plans
for the art gallery and upon the gallery's compliance with all other applicable City building,
permit, approval and review procedures.
3. The purchase price for the Property shall be not less than $26,800.00 (the appraised value
of the Property), adjusted by reasonable and customary closing costs.

EXHIBIT A
Part of Lot 1 & Lot 2 in Simeon Hawkin's Addition to Bethlehem, now Carmel,
Indiana, as per plat thereof recorded in Deed Record 30, page 441, in the
Office of the Recorder, Hamilton County, Indiana, more particularly described
as follows:
Beginning at the southwest corner of an existing building, said corner lying
approximately 0.5 feet north and 0.5 feet east of the southwest corner of Lot
1, aforesaid; THENCE northerly along the face of said building 126.00 feet to
a point approximately 0.5 feet east of the west line of said Lot 1; THENCE
westerly perpendicular to said building face 37.00 feet; THENCE southerly
parallel with said building face 126.00 feet; THENCE easterly perpendicular
to said building face 37.00 feet to the Point of Beginning. Containing 4,662
square feet (0.017 acres), more or less.
