CC-01-05-04-02 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA REGARDING THE HIRING OF OUTSIDE LEGAL COUNSEL WHEREAS, pursuant to Indiana Code 36-4-6-24 and Carmel City Code Section 3-16, the Common Council of the City of Carmel, Indiana, has the authority to hire its own legal counsel; and WHEREAS, Indiana Code 36-4-6-24 sets limits on the mount of monies which may be appropriated to pay the salary of legal counsel hired by the Common Council; and WHEREAS, as the legal services of the Carmel City Attorney may be used by the Common Council at no additional taxpayer expense, it is right and proper for the Common Council to limit its use of other counsel paid at additional taxpayer expense to those infrequent occasions when a majority of the Common Council determines that it is prudent and necessary to do so. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, that: Section 1. No attorney other than the City Attorney may be hired, retained or used by, or may appear on behalf of, the Common Council as its legal counsel except when the same has been authorized in advance by a resolution properly adopted and approved by the Common Council. If such legal counsel is properly retained by the Common Council, the same shall serve at the pleasure of the Council, shall perform only such legal services as he/she is directed to perform by the President Pro Tempore of the Common Council, or by a majority of the members of the Common Council, and shall not provide legal representation or advice to any individual Council member without the prior approval of the President Pro Tempore or a majority of the members of the Common Council. Section 2_.
