A RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF CARMEL,
INDIANA, REGARDING THE MAKING OF AN IMPROVEMENT l~ ,:9 ~'~e.;~ L~.~..~
WHEREAS, Indiana Code 31-9-9 permits landowners to petition their municipal works board requesting the
installation, maintenance and operation of a system of ornamental street lighting and posts with underground wiring; and
WHEREAS, Indiana Code 36-9-38 permits landowners to petition their municipal works board requesting the
installation, maintenance and operation of an ornamental street light system to seek the establishment of a municipal
improvement district and the funding of such improvement pursuant to Indiana law; and
WHEREAS, the purported owners of at least sixty percent (60%) of the parcels of real property located in a
portion of the area known as "Hunters Creek Villages" subdivision that is located generally southeast of the intersection
of 146a~ Street and Oak Ridge Road, west of Rohrer Road and north of Nevelle Lane, and includes all or a portion of
Bennett Court, Bridle Circle, Bridle Court, Winter Way, Winter Court, Saddleback Drive, and part of Howe Drive,
Bennett Road, Oak Ridge Road, and 146th Street, al1 in the City of Carmel, Hamilton County, Indiana, have now
prepared and presented a petition as described above ("Petition") to this Board for its consideration, a copy of which
Petition is attached hereto as Exhibit A and made a part hereof by this reference; and
WHEREAS, Indiana Code 36-9-9-3 requires this Board, upon receipt of such a petition, to adopt a declaratory
resolution for the making of the improvement described therein, subject to its right to later rescind or modify such
resolution in accordance with Indiana law.
NOW, THEREFORE, BE IT RESOLVED AND DECLARED by the Board of Public Works and Safety of
the City of Carmel, Indiana, that the ornamental street light system improvement referenced herein be made, subject to
and in conformance with Indiana law.

ADDENDUM TO PETITION FOR BARRETT LAW IMPROVEMENTS
A detailed description of the above improvement is:
We will be installing up to twenty-five lights throughout the neighborhood. These lights
will be a type of light fixture with the following (or substantially similar) characteristics:
*Approximately 12.5 feet in height
* 150-Watt high-pressure sodium light
*Aluminum pole
*Concrete Base
* "Acorn" style light fixture
*Underground wire set in conduit'
*Estimated useful light = .50 years

What would streetlights do for our neighborhood? Increase security in the area.
Increase safety for everyone (bus stops, children, walkers, etc.).
Increase the value of our homes.
o increase the aesthetics of the entire neighborhood.
What
are the costs?
Approximately $4,000 per light. (This includes complete installation (wiring, concrete pad, and
the light).
There would be up to 25 lights depending on the decision of the city consukant.
Estimated cost of 25 lights = $100,000.
Maintenance costs = $0. This is a joint project with the City of Carmel; therefore, the city will
maintain the lights and pay for the electricity.
can the neighborhood afford this?
The Barrett Law. This law allows for homeowners in a specific area to make improvements
that would benefit everyone in the area, and to assess all the costs associated with the
improvements to all the people in the area over a period of 10 years.
Traditionally the city has paid some percentage of these projects. They anticipate covering
between 15 and 30%, but there are no guarantees because they don't know how many other
Barrett Law Projects will be in the works.
Example: Based upon 25 streethghts needed and the city covering 20%. Total Amount: $100,000
Amount borrowed by neighborhood $80,000
$80,000/162 homes = $493 ~83 per home to be paid over 10 years
($49.38 per year ~ only $4.12 per month per house)
The Cky of Carmel will bill each and every homeowner (even those who don't sign the
petition) twice armually for the next ten years. The interest rate on this loan will be
approximately 5-10%. (You can choose to pay the lump sum to avoid the interest.)
This is affixed to the home, not the owner.
NOTE: The current interest rate, percentage the city is able to pay, and the number of
lights will determine the actual cost.
What needs to happen next?
1. A petition will have to be signed that allows the city to assign a consultant who will
confirm the number of lights needed, and the location of the lights.
2. The petition is then taken to the Assessor's office to verify the authenticity of each
signature. We need signatures from whomever is listed on the tax documents (in many
cases this would be both husband and wife). We need 60% (or more, in case of
relocation of some neighbors) of the homeowners' signatures before the consultant can
begin work. We have 162 homes so we need at least 98 homes to sign the petition.
3. A public hearing (resolution) will be held before the Board of Public Works and Safety.
This is an opportunity for each homeowner to ask questions about the project and see
the consultant's finalized numbers (number oflights, costs, etc.). The resolution is also
a chance to determine the final direction of the project.
