RESOLUTION NO. CC-05-03-04-01

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, APPROVING A RESOLUTION OF THE CITY OF CARMEL PLAN
COMMISSION RELATING TO THE AMENDMENT TO AND EXPANSION OF
CERTAIN ECONOMIC DEVELOPMENT AREAS IN THE CITY, AND APPROVING
THE EXPANDED BOUNDARIES THEREOF
WHEREAS, the City of Carmel Plan Commission (the "Plan Commission"), is the body
charged with the duty of developing a general plan of development for the City of Carmel,
Indiana (the "City"); and
WHEREAS, on February 10, 2004, the City of Carmel Redevelopment Commission (the
"Redevelopment Commission"), as the governing body for the City of Carmel Redevelopment
Department (the "Department"), pursuant to Indiana Code 36-7-14, as amended (the "Act"),
adopted the following resolutions:
(1) Resolution No. 4-2004 which amended and expanded the Integrated 126th Street
Corridor Economic Development Area (the "126th Street EDA") and approved an Integrated
Economic Development Plan & Amended Redevelopment Plan, including the 2004
Amendments thereto, dated February 10, 2004 (as so amended, the "Integrated Plan");
(2) Resolution No. 5-2004 which amended and expanded the Old Meridian Street
Economic Development Area (the "Old Meridian Street EDA") and approved the Integrated Plan
in connection therewith;
(3) Resolution No. 6-2004 which amended and expanded the North Illinois Street
Economic Development Area, re-designated such area as the Illinois Street Economic
Development Area (the "Illinois Street EDA'') and approved the Integrated Plan in connection
therewith;
(4) Resolution No. 7-2004 which amended and expanded the Plum Creek/Hazel Dell
Parkway Economic Development Area (the "Hazel Dell North EDA") and approved the
Integrated Plan in connection therewith; and
(5) Resolution No. 8-2004 which amended and expanded the 96th Street/Hazel Dell
Parkway Economic Development Area (the "Hazel Dell South EDA'') and approved the
Integrated Plan in connection therewith (Resolution Nos. 4-2004, 5-2004, 6-2004, 7-2004 and 8-
2004 are hereinafter collectively referred to as the "Redevelopment Commission Resolutions,"
and the 126th Street EDA, the Old Meridian Street EDA, the Illinois Street EDA, the Hazel Dell
North EDA, and the Hazel Dell South EDA are hereinafter collectively referred to as the
"Economic Development Areas"); and
WHEREAS, the amendments referred to above expand each of the respective Economic
Development Areas by more than twenty percent (20%); and
WHEREAS, the Redevelopment Commission submitted the Redevelopment Commission
Resolutions and the Integrated Plan to the Plan Commission for approval pursuant to the
provisions of Section 16 of the Act; and
WHEREAS, on April 20, 2004, the Plan Commission reviewed the Redevelopment
Commission Resolutions and the Integrated Plan and determined that they conform to the plan of
development for the City, and adopted a resolution approving the Redevelopment Commission
Resolutions and the Integrated Plan (the "Plan Commission Order"); and
WHEREAS, the Common Council of the City (the "Council") now desires to approve the
Plan Commission Order pursuant to Section 16 of the Act and the determination that each of the
Economic Development Areas, as expanded, is an "economic development area" under Section
41 of the Act;
NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of
Cannel, Indiana, as follows:
1. Pursuant to Section 16 of the Act, the Council hereby approves the Plan
Commission Order and the determination therein that the Redevelopment Commission
Resolutions and the Integrated Plan, in all respects, conform to the plan of development for the
City, and approves in all respects, the Redevelopment Commission Resolutions and the
Integrated Plan.
2. Pursuant to Section 41 of the Act, the Council hereby approves the determination
that each of the Economic Development Areas, as expanded by the respective Redevelopment
Commission Resolutions, is an "economic development area," and approves the enlargement of
the boundaries of the respective Economic Development Areas as provided in the
Redevelopment Commission Resolutions.
3. This Resolution shall be in full force and effect from and after its adoption by the
Council.
