CC-06-21-04-05 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, iNDIANA TO CREATE A TASK FORCE TO STUDY THE TOPIC OF RESIDENTIAL ARCHITECTURE FOR NEW HOMES IN THE CITY OF CARMEL AND CLAY TOWNSHIP WHEREAS, IC 36-7-2-2 provides that a unit of local government may plan for and regulate the use, improvement, and maintenance of real property and the location, condition, and maintenance of structures and other improvements; and WHEREAS, under IC 36-7-2-4, a unit of local government may also regulate methods of, and use of materials in repair, alteration, and construction of structures and other improvements; and WHEREAS, IC 36-8-2-4 further authorizes a unit to regulate conduct, or use or possession of property, that might endanger the public health, safety, or welfare; and WHEREAS, it is in the interest of all homeowners and other residential property owners in the City of Carmel and Clay Township to conserve property values while at the same time promoting responsible development and groWth; and WHEREAS, alt residents and property owners in the City of Carmel and Clay Township wish generally to protect the public health, safety, and welfare and to take all measures necessary to improve the quality of life in the City and the Township; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, that it hereby adopts this Resolution to create a Residential Architecture Task Force. Section One: There is established the Cam~el Residential Architecture Task Force. The Task Force shall study (a) the design of, and materials used in the construction of new residential structures in the City and in Clay Township; (b) whether the ordinances of the City (including zoning ordinances that apply throughout Clay Township) should be amended to further regulate such design and materials; and (c) any related issue as determined by the Task Force. Section Two: The Task Force consists of the following seven (7) members: (a) three (3) members of the Builders Association of Greater Indianapolis appointed by the Mayor of the City upon the recommendation of that Association; (b) one (1) member who is an architect, registered in the State of Indiana, appointed by the Mayor of the City; (c) one (1) member appointed by the Carmel/Clay Chamber of Commerce appointed by the Mayor of the City upon the recommendation of the Chamber; (d) one (1) member of the Common Council, appointed by the Council from its membership; and (e) one (1) citizen member, appointed by the Mayor of the City. Section Three: The staff of the Department of Community Services shall provide staff support to the Task Force. Section Four: The Task Force is hereby directed to report, on or before September 20, 2004, to the Common Council as to the findings and recommendations that it may make pursuant to this Resolution. After its adoption, this Resolution shall be filed in the office of the Clerk-Treasurer of the City of Carmel, who shall also forward one (1) copy of this Resolution to the executive director of the Carmel/Clay Chamber of Commerce and one (1) copy to the executive director of the Builders Association of Greater Indianapolis.
