A RESOLUTION OF THE BOARD OF P~ AND SAFETY OF THE CITY OF
CARMEL_~INDIANA, REGARDING WOODLAND COUNTRY CLUB SUBDIVISION WITHIN
- C-257 SERVICE AREA
WHEREAS, the City of Carmel, Indiana, owns and operates a water utility and a sewer utility
providing service within and around its corporate limits; and
WHEREAS, to the extent the City extends a water and/or sewer service main to an area not
currently provided such services by the City, the persons served thereby are responsible for the pro rata
share of the costs and surcharges related thereto; and
WHEREAS, pursuant to Cannel Corranon Council Ordinance No. D-1635-03 ("Service
Ordinance ), homeowners wishing to be served by City water and/or sewer, when such service will
require the extension of a City main, are required to sign an agreement ( Consent Agreement ) stating th
they have notice of and understand the applicable costs related thereto, are agreeable to the main
extension(s) and will connect to same when they are in service and available for connection, and will pay
such pro rata costs and surcharges; and
WHEREAS, pursuant to the Service Ordinance, at least thirty-five percent (35%) of the
homeowners with frontage along City main extension(s) in an area to be served by City water and/or
sewer in accordance therewith main must sign a ConSent Agreement prior to the City's final preparation
of plans and its advertisement for construction bids associated therewith; and
WHEREAS, more than fifty percent (50%) of the homeowners in 'the Woodland Country Club
Subdivision C-257 Service area, as is further identified in attached Exhibit A incorporated herein by
reference (the "Woodland Country Club Subdivision C-257 Service Area"), have now signed a Consent
Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of the City
of Carmel, Indiana, as follows:
1. The foregoing Recitals are incorporated herein by reference.
2. The City of Carmel and its Utilities Department are authorized to proceed for~vard with the
completion of the final design, and the procurement of all financing, permits and construction bids
necessary or convenient to the extension(s) of City main(s) and the provision of water and/or sewer
service to the Woodland Country Club Subdivision C-257 Service Area.
3. The homeowners in the Woodland Country Club Subdivision C-257 Service Area shall be
obligated, pursuant to the Service Ordinance and this Resolution, to each pay their pro rata share of all
authorized costs and surcharges incurred in the provision of such services to said Area.
