HomeMy WebLinkAboutBPW-02-10-86 Court Bailiffs Req RESOLUTION OF THE CARMEL BOARD OF PUBLIC WORKS AND SAFETY WHEREAS, the Board of Public Works and Safety of the City of Carmel, Indiana, is the directing and supervising body of the Carmel Metropolitan Police Department; and WHEREAS, the Indiana State Board of Accounts has requested the Office of the Mayor and the City of Carmel to cease providing a Carmel police officer to work as a bailiff for the Carmel City Court, for the reason that said police officer is, in the opinion of the Indiana State Board of Accounts, receiving two salaries or compensations while being paid by the City of Carmel as a full- time police officer; and WHEREAS, the Office of the Mayor of the City of Carmel has proclaimed that no city employee shall serve in the capacity of bailiff for the Carmel City Court in accordance with the wishes of the Indiana State Board of Accounts. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety for the City of Carmel, Indiana, that commencing the ~ day of February, 1986, no Carmel police officer of any rank or position, shall serve as the bailiff of the Carmel City Court. BE IT FURTHER RESOLVED that violation of this resolution bya any police officer shall subject said officer to disciplinary action pursuant to I.C. 36-8-3-4 and will be considered a viola- tion of the rules, regulations and policies of the Carmel Metropolitan Police Department and this Board. All interested parties are hereby notified that a public hearing will be held before the Carmel Board of Public Works and Safety of the City of Carmel, Hamilton County, State of Indiana, on the 10th day of February, 1986 at 5:15 P.M. in the Carmel Meeting Hall, located at 15 First Avenue, N.E., Carmel, Indiana, upon a proposed Lease to be entered into between the City of Carnal, Indiana, through its Board of Public Works and Safety, as thc leasing agent and Lessee, and the proposed Lessor of the proposed s[ructurc is a site upon which a Master Fire Station, Parking Area, and Civic Square is to be erected, the site which is more particularly described as follows: An ll-acre tract of land locat~ed immediately west of Rangeline Road and lying north and south of Gradle Drive, in Hamilton County, indiana. The character of the structure is a now master fire station, parking area and civic square 311d amphitheatre. The proposed lease upon which the hearing will be held is for a term of twenty-two (22) years, commencing with the comp]ctio~] oi Lhc master fire station, parking area and civic square, to be erected by the Carmel Civic Square Building Corporation. The ]case provides for an annual rental of Five Hundred Twenty Five '¥h,~usa~]d Do].l~rs ($525,000.00) per year, payable semi-annually on June 28th al]d December 28th of each year during the term of the lease, commencing with the completion of the master fire station, parking area, and civic square. As additional rental, the Lessee shall maintain insurance on the building as required in the lease, and shall pay all taxes and assessments against such property, as well as the costs of alterations and repairs. The lease provides that after the sale of the first mortgage bonds to pay the costs of said building, including the acquisition of the site thereon, and other expenses incidental thereto, the annual rental shall be reduced to an amount equal~ the multiple of One Thousand Dollars ($1,000.00) next highest to the highest principal and interest due in any year ending on a bond maturity date on such bonds, plus Two Thousand Dollars ($2,000.00) payable in equal semi- annual installments. The lease gives an option to the Lessee to purchase the property on any rental payment date. The building to be erected will be a master fire station, parking area, civic square, and amphitheatre, and the proposed lease, drawings, plans, specifications, and estimates for the structure are open to public inspection at the office of the Clerk-Treasurer, Carmel City Building, 40 East Main Street, Carmel, Indiana, during the regular business hours from 8:00 A.M. until 4:30 P.M.
