Homeowner acknowledges and agrees to the following: Homeowner isrequired to obtain written approval from the Architectural Review Board (“ARB”) before making anychanges or improvements to property. No changes or improvements are permitted to be started prior toreceipt of the ARB’s written approval. ARB has up to thirty (30) days from receipt of all required materialsto review and respond to each change request. If Homeowner receives no response from the ARB withinsaid thirty (30) days then the request is to be considered denied. Any structure, fence, deck, patio, outdoor firepit/fireplace, driveway, swimming pool, basketball goal (portable goals prohibited), tennis court, mailbox, flagpole, lighting fixture or pole, landscaping, or exterior modification to the original construction on any lot must receive written approval from the Jackson’s Grant Architectural Review Board (“ARB”) prior to construction/installation. This includes changes in color. 2. All requests for approval shall be made in writing with the required application and shall include: x Surveyor’s Plot plan of lot showing location of improvement drawn to scale with dimensions. x Elevation (side view) and applicable construction plans or drawings of proposed improvement. x Photos of proposed or similar improvement (as needed, also include photos of major materials to be used). x List of all visible construction materials to be used (including colors) which, as applicable, must conform to those used on the original building or be sufficiently compatible. x Requests to change color of exterior siding/brick also require color photos of: i) the subject property, ii) the 3 homes directly across street, and iii) next 2 homes on each side of subject property. 3. Fences: x All fences require written ARB approval prior to construction/installation. x Fences are to extend from back corners of home unless ARB specifically approves an exception. x Examples of acceptable fence styles are: wrought iron, wrought iron looking (decorative aluminum, ornamental steel), and wood or wood composite picket. Chain link fences are prohibited. x Fences must be built of decay resistant wood or wood composite, wrought iron, aluminum, steel, or other acceptable material (vinyl/pvc material is prohibited). x Spacing between fence pickets shall be no less than one-half the width of the picket face. x Perimeter fences are not to exceed forty-eight inches (48”) in height except that wrought iron, decorative aluminum, and ornamental steel fence styles may be up to sixty inches (60”) in height. x Fences immediately around a deck, patio, or pool may be up to seventy-two inches (72”) in height and be of a permitted semi-opaque design to provide screening of the enclosed area. Except for alley-load homes, privacy fences typically shall not extend beyond sides of the home. x Fences must be properly maintained at all times. x Underground invisible fencing does not require ARB approval, but must be installed at least three feet (3’) from all property lines and sidewalks, and is subject to all municipal and utility easements and restrictions. 4. Rear yard improvements such as decks, patios, outdoor fireplaces, playsets, swimming pools, etc. are required to sit directly behind home and not extend past sides of home, except for alley-load homes or in instances where lot/yard conditions do not permit, as determined by ARB. 5. No detached, stand-alone mini-barns or storage sheds are permitted. 6. Outside antennas and satellite dishes in excess of 39” in diameter are not permitted unless specifically approved by the ARB. Satellite dishes of less than 39” in diameter require ACCORDANCE approval as to location, color and other aesthetic considerations. 7. Outdoor storage of recreational vehicles, boats, jet skis, trucks, cars, motorcycles, trailers, etc. is prohibited. 8. No metal or fiberglass awnings or patio covers are permitted. 9. No above-ground swimming pools in place for more than forty-eight (48) consecutive hours are permitted. 10. No playsets, trampolines, or sandboxes are permitted in Stableside, Bridgemont, Exmoor, and Hamlet. 11. Basketball goals are required to have a clear backboard and black post. Portable style goals are prohibited. 12. Exterior accent lighting may only be from concealed low level fixtures with light source/bulb shielded from view of any street, sidewalk, or adjacent lot, and designed so that light is not directed off the site. 13. Requests to replace/exchange a street tree in the right-of-way area in front yard of home may only be with the same type of tree due to restrictions set forth by area municipalities. 14. For any encroachment into an easement, owner must obtain permits/approvals as may be required by the applicable regulatory authority. Prior to installation, owner must obtain permit/approval from Hamilton Co. Drainage Board for any encroachment into a Regulated Drain Easement (RDE or DE) as shown on the Recorded Plat and/or your Plot Plan and applications for said encroachment must be submitted to Hamilton Co.
