RESOLUTION CC-01-10-05-01
AS AMENDED
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~
TO CONSIDER THE BENEFITS TO THE CITY IN CONTINUING SHARED FIRE~ PARK~;
COMMUNICATIONS~ PLANNING AND ZONING SERVICES WITH CLAY TOWNSHIP
WHEREAS, it would appear to this Council that if the residents of South West Clay Township
("Township") do not become a part of the City of Carmel ("City") as a result of a defeat by them of
Ordinance No. C-263, it may be in the best interests of the citizens of the City to no longer be a partner
with the residents of the unincorporated areas of the Township for the purpose of providing certain shared
services; and
WHEREAS, while it is thought by this Council that the preliminary opinions of our consultants
bear out this assumption; and
WHEREAS, there have been differing opinions expressed by those both for and against the
annexation in regards to the benefits to the City's residents of these contracts, interlocal or joinder
agreements; and
WHEREAS, there have been differing opinions expressed as to the ability of the City to no longer
be a party to these contracts, interlocal or joinder agreements with the Township; and
WHEREAS, before dissolving any or all contracts and agreements with the Township for
provision of services to the people of the Township who are not residents of the City, this Council feels it
is necessary to have more in-depth study of each contract or agreement to make certain that the breaking
of said contracts, interlocal or joinder agreements is in the best interests of the taxpayers of the City; and
WHEREAS, this Council does not want any citizen, either of the unincorporated areas or of the
City, to feel or express that they were not informed of this possible action beforehand.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel,
Hamilton County, Indiana, that:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. The fire, parks, and communications interlocal or joinder agreements be studied
in depth to determine:
a) the fiscal effect on the taxpayers of City emanating from the breaking of the contracts,
interlocal or joinder agreements;

b) the actual assets involved under these contracts, interlocal or joinder agreements, especially in
regards to the Fire and Parks Departments, and how those assets will be allocated;
c) the ability of the City to absorb those personnel who now are assigned to providing services
to the Township;
d) the social and economic effect on the City of not providing planning and zoning services to the
Township;
e) the method by which each contract, interlocal or joinder agreement can be broken; and
f) the most appropriate timetable for ceasing the delivery of combined services to the Township.
BE IT FURTHER RESOLVED that through the Council President the Council's fiscal and legal
consultants be given this task with a deadline for reporting back to the Council at it's February 21, 2005
meeting.
SO RESOLVED by the Common Council of the City of Carmel, Indiana, this ~ O4t~ day of
