D- 1775-05 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~ ADDING CHAPTER 8~ ARTICLE 5~ SECTION 8-47(a)(28) TO CARMEL CITY CODE WHEREAS, the Common Council has previously enacted legislation prohibiting vehicle parking in certain locations within the City, such legislation being codified as Carmel City Code Section 8-47; and WHEREAS, the Common Council now finds that the public interest will be served by forbidding vehicle parking on the south side of 4th Street N.W. from its intersection with 1st Avenue N.W. east to its intersection with Range Line Road, all located within the corporate limits of the City. ,.,,~ NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Chapter 8, Article 5, Section 8-47 of the Carmel City Code is hereby amended by the addition of Section 8-47(28), which shall read as follows: "Sect. 8-47(28). On the south side of 4t~ Street N.W, from its intersection with 1st Avenue N.W. east to its intersection with Range Line Road." Section 3. The Carmel Street Department shall post appropriate signs and markings on the above described public street. Section 4. The remaining provisions of Carmel City Code Chapter 8, Article 5, Section 8-47 are not affected by this Ordinance and remain in full force and effect. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any fights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those fights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement o f same can be given the same effect.
