HomeMy WebLinkAboutD-1785-05 Council President ElectionCOUNCILOR(S): Joseph Griffiths and Richard Sharp ORDINANCE D-1785-05 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~ AMENDING CHAPTER 3~ ARTICLE 1~ DIVISION II~ SECTION 3-13(a) OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel, Indiana, has the authority to amend the Carmel City Code; and WHEREAS, the Common Council desires to amend Chapter 3, Article 1, Division II, Section 3- 13(a) of the Carmel City Code. NOW, THERFORE, BE 1T ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Carmel City Code Chapter 3, Article 1, Division II, Section 3-13(a), is hereby amended to read as follows: "§ 3-13 President Pro Tempore. (a) The Common Council shall elect from its membership at its last regular meeting each year a President Pro Tempore to serve the following calendar year for a term of one year, except that in years when a genera[ election is held to elect Common Council members, the election of a President Pro Tempore shall take place at the Common Council's first regular meeting of the year for which such officer is to serve. The President Pro Tempore shall not be eligible to succeed himself/herself for the following year." The remaining portions of City Code Section 3-13 are not affected by this Ordinance and remain in full force and effect. Section 3. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. Section 4. This Ordinance shall be in full force and effect upon approval of the Common Council, execution by the Mayor and such publication as is required by law. Section 5. Should any provision or portion of this Ordinance be declared by a court of competent jurisdiction to be invalid for any reason, the remaining provisions shall not be affected so long as they can, without the invalid provision, be given the effect intended by the Common Council in adopting this Ordinance.
