The reason for the installation of the fence is to contain a dog that can jump higher than 42”. Therefore,
this proposal includes fence height of 60” on the side yard, parallel to Warbler Way, which is a “front
yard” as related to fences. At that height, the fence will be less than the 72” maximum for residential
fences in rear and side yards. It will match the height of the portion of our neighbors’ fence that also
runs parallel to Warbler Way.
Neighbors’ (to the South) Fence, parallel with Warbler:
Although the proposed fence will be taller than usual on the side of the property, it is constructed of
ornamental iron and not meant for privacy. Therefore, it will meet the “25% Open” requirement of
“Front Yard” fencing. The proposed fence location is well clear of the 20’ Drainage and Utility Easement
on the Eastern side of the property and does not extend forward past the back corner of the residence.
It is also outside of the Drainage Easement on the Western Side of the property, so it will not require a
“Consent to Encroach” from Carmel’s Engineering Department. For these reasons we will request a
variance from the City of Carmel if one is required and we would expect to receive that variance after
approval is granted by the HOA.

I am pleased to inform you that the Architectural Review Board has approved your request for the following
item(s):
Install ornamental steel fence in Majestic style per specifications submitted by Bullseye Fence
Company.
It is your responsibility to obtain any necessary permits or variances and follow the guidelines mandated by the
county, city, or state and to ensure all improvements are within your property line and setbacks. Also, be aware that
you are responsible at your expense to move anything in the easement if a utility company needs to have access to
that area. You are responsible for maintaining proper drainage in areas affected by work and for erosion control.
