Approval of Meeting Minutes of June 28,2021 Meeting:
A Motion made by Dierckman and seconded by Hawkins to approve the June 28,2021 BZA meeting minutes.Approved 5-0.
Adoption of Findings of Fact from June 28,2021 meeting:
A Motion made by Dierckman and seconded by Hawkins to adopt the Negative Findings of Fact of Docket No. PZ-2021-
00100 V. Approved 5-0.

1. Introduction of new BZA Legal Counsel, Sergey Grechukhin
2. The GOAT Restaurant& Tavern Use Variance and Development Standards Variances petitions are withdrawn per
8/12/21 & 8/13/21 correspondence.
3. I have distributed a draft of the BZA Rules of Procedure that goes over new rules and the required documentation
when the Board approves and disapproves a petition.
Public Hearings:
(UV)Recovery Auto.
The applicant seeks the following use variance approval:
1. Docket No.PZ-2021-00135 UV UDO Section 3.01 Prohibited Uses in Overlay,Automobile Sales &
Display requested. The site is located at 10601 College Ave., at the northeast corner of 106`' St. and College Ave.
It is zoned B2/Business and Home Place Overlay District, Business Sub-Area. Filed be E. Davis Coots of Coots,
Henke& Wheeler, PC on behalf of Dianwei Wang and Meili He, owners.
Petitioner: Dave Coots,Coots, Henke& Wheeler, PC:
• The BZA approved this Use Variance request in 2019,and we are back to renew this Use Variance so the owner,
Mr. Wang can continue the sale of automobiles at this location
• We are asking for 3 years for our time limit for this UV request. The Carmel Redevelopment Commission(CRC)
are planning to redevelop in this area, but nothing has been finalized. 3 years will be enough time.
• Future plans for a roundabout at 106`'and College Ave are in the plans, but they have not told us when

Department Report: Angie Conn
• The Homeplace overlay district allows for neighborhood like village with commercial activity. That is in the
CRC's future plans for this intersection.
• Automobile Sales is a prohibited use within the Homeplace overlay district
• A future roundabout will be installed at this intersection
• Staff recommends positive consideration of this UV with the time limit of 1 year and the owners dedicate the
ROW to the City for the future roundabout
Board Comments:
Kent: What's the timeline for the roundabout at 106`' and College Ave?Angie Conn: We do not know. We think it will
occur within 1 to 3 years. Kent: How long has the current owner owned this site?Dave Coots: The property to the east
for 15 years. Mr. Wang purchased the adjacent property a few years ago. Kent: I'm more in favor of a 2-3-year time
limit than just 1 year. Leo: I also agree with 3 years.
Jim: Did the original UV petition include the dedicated ROW? Angie Conn: It did include it, but we want to make sure
this is covered with this petition. Dave Coots: We dedicated 45' off of 106'h Street, and 50' off of College Ave. If the
City needs more than that for the future roundabout, we have not been notified. The City Council recently approved a
$25 million bond that included this intersection, but we have not been notified of a construction timeline.
A Motion by Grabow and seconded by Dierckman to approve Docket No. PZ-2021-00135 UV with the Condition
of a 3-year limit and to adopt the Petitioner's Findings of Fact.
Approved 5-0.

The site is located at 220 2'St. SW(former Bub's Café site). It is zoned R2/Residence and Old Town Overlay,
LLC.
