1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
the swimming pool is a customary accessory use for single family residential land uses and the subject
swimming pool and surrounding deck have been in place and in use for approximately 15 years without
incident or detriment to the neighborhood or the platted drainage easement.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
swimming pools are customary accessory uses for single family residential land uses, there are numerous
other nearby residences that also have swimming pools, and the swimming pool and surrounding deck have
been in place and in use for approximately 15 years without incident or detriment to the neighborhood or the
platted drainage easement.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties
in the use of the property because:
the swimming pool and surrounding deck, common accessory uses to single-family residences, generally,
and in this neighborhood particularly, have been in place and in use for approximately 15 years without
incident or detriment to the neighborhood or the platted drainage easement, and constitute significant
construction that cannot be moved from the current location.
DECISION
IT IS THERFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. rz-2c 2 -00 1611 V is granted,subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.
