tower bro%~ht up. Mr. H.F.Zinsmeister~Jr. to find out if there ia ,a guar-
anteed time limit.
He suggested the Clerk-Treasurer request the Indiana Stream Pollution Control
Board allow their consulting engineer, Clyde E.~il!iams Associates to obtain'
p. L. 660 Grant Application Forms. ~lso that he had been contacted by a Mr.
Stubbs in regard to the removal of the old water tower.
Mr. Robert R.Oreenmonwas appointed to fill the vacancy on the Board of
Zoning Appeals.

was called to Order at 7.45 P. M. o'clockat the Tmon Hall by RusSell Ransom,
Vice-President. Board msmbers present: James J. Ritchey and Max Johnson.
To~m personnel present: James Beard, ~Donald Swai!s, Jr., James O. DouEh-
erty, Homer B. Orad!e and Leroy M. New.
The minutes of the regular meeting held on March 14, 1967 read and approved.
J~mes Beard, Chief of Police and Donald Swails, Fire Chief pre~ented reports
of their respective departments for the month of March.
R6bert E. Molloway, who will complete his probationary per~od as a patrolman
M~rch 31, 1967, will be c~as$ified as a reELtlar policem~u April 1, 1967 and
salary raised to $ 5,304.00 per year.
James Deugherty, Utilities Superintendent, reported on the following items:
The H0osi.er Monument ~q6mpany, Inc. p~esented a bid of ~ 3,700.00 ( $300.~0
for buildmng and ~3,hOO.~O for t~e~) to dismantle and remove old water
tower and police buildiug. James Ritchey made a motion, seconded by Max
Johnson~ and passed unanimously to remove tower and the other building on
the premises.
The A. B. C. Construction Company to be billed for $ h~.~O , cost of re-
setting hydrant in Flair North Addition.
Repairs on the tractor will cost approximately 8 93.00~ Mr. DougJuerty was
authorized to have repairs made. Also, if possible, to dispose of old back
hoe.
A motion by Max Johnson, seconded by Russell Ransom~ and passed unanimous-
ly te purchase a Chevrolet truck from W. Hare & Son, Noblesville, ~diana
for the bid price of $ 3,73~.00. To be dscided at next meeting from which
accounts same is to be paid.
A public hearing was held on an ordinance in regard to a natural gas fran-
chise agreement bet~een the Town of Carmel and the Indiana Gas and Water
Company was held. There being no cotangents on the same, the hearinE was
closed. Action on the enabling ordinance was carried over to the regular
meeting April 1!, 1967 due to the absence of two (2) members of the Board
Of Trustees. ~ ~
The Town of Carmel authorized the payment of Christmas !ightsfer streets
~t.of ~ llS.24,1ess ~ 25.00 , paid as a donation by Public Service Ind-
iana, If possible~ same to be paid by B. & P. Womens Club.
James Ritchey made a motion~ seconded by Max Job_uson to release the construct
ion bon~ on %¢ilson Village, t~nird Section and to accept maintenance bond on
the same. Carried unanimously.
Mr. Atkinson, representing Atkinson & .Company, asked for release of construst-
iOn bond on Harrowgate subdivision, Third section and Joseph Dawson, repre-
senting Cool Creek Estates,asked for release of construction bondon Cool
Creek Estates~ First Section. After inspection, neither could be granted
until the contracts are satisfactorly completed. ~
A public hearing wae held on the agreement and proposed enabling ordinance
with American Suburban Utilities, Inc,. After co~nents and discussion the
hearing was closed. On a motion by James Ritchey, seconded by Max Johnson,
~was .adopted. unau~imous!y with the understanding .that the ~oeat offence

American Suburban Utilities, Inc. and the Town of Carmel Whereby the

(1) ~ The agreement between the Board of Trustees of the Town of Car,
reel, Indiana and the Lmerican Suburban utilities, Inc., an Indiana cor-
poration, dated the 2~th day of March, 1967, generally providing for the
immediate construction of a sewage treatment facility for the Town of Car-
met by ~eystone square Co~a~y at 96th and ~nite _River without interfer-
ence~ directly er indirectly, by American Suburban Utilities, Inc. and
agreement by the T~n of Carmel to accept aud treat sanitary sewage col-
!ected by American Suburban Utilities, Inc. within its Certified Area in
Clay T~mship~ Hamilton County, Indiana be and the same is hereby~ in all
things ratified~ cch'firmed and approved.
(2) The said agreement is ordered filed by the Clerk Treasurer and
a copy made available at all times during regular business hours in the
office of the Clerk Treasurer for inspection by an~ interseted citizen and
the appropriate officials and e~ployee, s Osf the Town of Carmel are hereby
authorized and emp~ered to do all th~ng necessary and expedient in carry-
~ng out the terms aud conditions of said agreement with American ~uburban
Uti!i%ies, Inc,
This ordinance shall be im full force and effect immediately from and
after its passage.

This letter will serve as a supplement to the sewer agreement ent-
ered into by the Town of Carmel and American Suburbav Utilities, Inc. on
March 28, 1967
~PLEHE~S, American Sub~rban Utilities, Inc, agreed in the above sub-
ject 'agreement to pay to the Town ef Carmel a per diem penalty of One
Hundred Dollars ($!00.00) for violation as described in 'e×hibit C" of the
agreement.
~tility does now further agree that if reoccun-ence of the same
specific viole~tion occurs within ~ Twel~ve months periods that the pen-
~21~ ef O~e Hundred Dollars ($100.00) per diem will commence twer~ty-four
hours after ~ritten notice has been given to the utility by %he Town
Of Carmel.

b~r. Beard was authorized to arrange with the Carmel Sign Company for a sign
for the %~ater Company Bui!dinE and the departnents with offices in the same.
.~le also presented Mr. Smith~ activities di~!ector of the Carmel chapter of the
Order of DeMolay. N~. Smith offered the assistance of the members iu making
a safety check of automobiles. Ss_me was accepted with thanks by the T~-~n
Trustees and the Police Chief.
Messrs. Luis ~ffeil~ John 'Thompson and Pat Riggens ~residing in Carmel Village
subdivision ~omplained of the speed of automobiles in Carmel Village an~
requested that signs be used in the area as a roes_us in attempting to reduce
the spee~ of automobiles in this ares, offering to put sameiu at their own
expense, Trustee Ransom to meet with men in the area to tNy to sel~e the
problem.
Max Johnson ~nd Charles Miller preserted a list of s~reets in the T~n of
8armel tp be repaired .this year. S~e was approved by bhe Board of Trustees.

Fire Chief Swails presented reports for the month of March and for the ff_rst
Guarter of 1967. He has received no satiafactory applications for the posit-
ion of a regular fireman,
Both the Police Chief and the ~irs Shief brtught up the subject of a pension
for the employees in their respective departments. Ss~me to be taken under
advisement.
Oradle Brothers, Inc. presented a bid for .installing sewer main for use by

Donald Swails, Jr., Fire Chief, presented a re~ort of the Fire
Department for the month of 'June.
Cm. a motion by James Ritchey, seconded by ~Jax Johnson, Paul Platt,
Jr. was appoimted Assistant Fire Chief, effective July l, 1967 at
a salary of ,~ 5532.00 per year. Vote was 4 ayes, i no.
Forest Stoops was present, speaking for tho officers of the new
swimming po&l,asking if the Water Company of the Town of Carmel
would furnish water for the same. The matter was to be considered
but no action was taken.

~n view of the fact that this annexation was on prtition from the
owners of all the land, there was no requirement to read the ordi-
nance mot2 than one time and the same was called up for final
action by the president.
On motion by Donaid Fields, and seconded by i~ax Johnson, Special

present and voting. The Clerk was directed to post copies of this
ordinance at one or more public places in eac~ ward of the Town Of
Carmel for ten (10) days following passage thereof, all in accord-

There were no arguements against the ordinance and thr public
hearing was declared closed. F~nal action to be taken at the regu-

~essrs. Thompson and Fearrin, representing the Advisory Board of
Clay Township, were present in regard to Fire and Zoning contrcts
for 1~68. Inasmuch as the Town Board has not met to set up a
budget for 1968, it was decided to arrange a meeting with the
Clay Township Trustee and Adviso~ Board at a later date.
It was agreed to release the construction bond on the fourth sec-
tion of $~ of Wilson Village and to accept a maintenanbe bond
on the same agreeable to yhe Town attorney, ~. New. It was also
stipulated the Thomas Wilson Company would furnish two copies of
Se~ctions Three (3) and four (4)of Wilson Village as constructed.
~Nr. Dougherty was requested to meet with ~. New in regard to
presenting a sewer ordinance in regard to strength of pipe, type
of seal and specifications for installation. Discussion as to curbs
in streets. It was decided to take bids on approximately two thous-
and (20005 feet of curbing.

WHEREAS, Chapter 298, Acts of the 1957 Indiana Ganeral Assembly
and th~ Federal Water Pollution Control Act provide financial~ aid
for the construction of se%~e tra&Imemt worka; and
~H3~REAS, the Town of Carmel, herein called the Eunicipality,has
plans for a municipal water pollution contol project generally
described as "Additions to wastewater treatment plant including
new primary and final settling tanks, aeration tank, digestion
and chlorination facility,also, the development of an interceptor
sewer,"which plans have been prepared or will be completed by
July 31.1967, and the Nunicipality intends to proceed with the
construction of such works;
NOW,THEREFORE,BE IT.RESOLV31~D by The Town Board of Trustees, the
governing body~of said ~unicipapity, as follows:
1. That Russell E. ~qansom be aut~orized to make application
for a State grant and provide the Steam Pollution control Board
such information,date, and documents pertaining to the application
for a grant as may be required, and otherwise act as the author-
ized representative of the Eunicipality in connection with said
application.
That the ~nicipality ~rees that if a Federal grant and
State assistance for the Project are Provided pursuant to Section
8 of the Federal Water Pollution Control Act, as amanded $ 33
U.S.C. 4~6 et seq.), and Chapter 298, Acts of 1967 Indiana Gener-
al Assembly, the Town of Carmel will pay the remaining costs of
the approved construction.
3. That all statements, data, and supporting documents made or
suDmitted by the ~unicipality in connection with any application
for Federal assistance for the proposed construction are to be
deemed a part of the application for State assistance.
4. That the Municipality agrees to comply with the requirements
of the Steam Pollution Control Board.
5. That certified copies of this resolution be prepared in quad-
ruplicate to accompany an application for a State grant for the
construction of the municipal water pollution control project.

T~e regular meeting of the Board of Trustees of the Towm Board
of Carmel, Indiana was called to order at 7.00 o$clock P.M. at
the Carmel-Town Hall by Russell Ran~om, President, ~it~ all mem-
bers o~ the Board present. Town perspnnel present: James Beard',
Donald Swails, Jr., Homer Gradle and Leroy New.
The minutes Of the regular meeting held on July 11 and the spec-
ial meeting held on july 20, 1967 read amd approved with the
addition that the Water Company will make ~e initial fill of
tf~e Carmel pool every year for the next five years free of charge
if th~ pool o~anization is not meeting expenses.
The only bid received on new curbing was from Gradie Brothers,
Inc. Two thousand (2,O00$ feet of concrete curbing'for a total
of $ 10,~OO.OO(removel of existing curb $.50 pe~ f~ot~ $1,O0.OO,
reconstructed curb, $2.50 per Foot, $9000.00). ~he~e$[r~tes to
be used if there are more or less feet cons~ructed~ B~d to be
taken under advisement.
The tabulation of the lo~ bid of the KeyStone Square Compan~ for
Division 2, Interceptor sewers of the Carmel Clay taste Water
treatment Project received, and upon the advice 'of Clyde E. Wil-
liams & Associates tentatively accepted with th~ formal award to
be made at the next regular meeting, August 8, 196T. Upon a mot~e
ion by Donald Fields, seconded by William Pattison,' the report of
the engineers was accepted unanimously.
~. Ed Kenny, repr,senting Clyde E. Williams & Associates pre-
sented ~ivision 2, Phase ~ of the sewer plans and said it was
necessary to make an agreement with Keystone Square Company.
Upon a motion by James,_$eConded by Donald Fields, it was agreed
unanimously to do so. ~
A publi~ was held on Ordinance No. B-8~An ordinance to appropri-
ate additional funds for Other Contracbural Funds for the i~otor
Vehicle Highway Funds was read by the president. There bein8 no
remonstrators the hearin8 was closed. Donald ~ields moved tQ adopt
the ordinance, same was seconded by Max Johnson and by Vote'was
carried unanimously. T
The Clerk-Treasurer was instructed to se~ up a separate accou nb
o£ finances received by the Keystone Square Company account as
per the following resolution:
Upon instructions from the Board of Trustees of the Town of Carmel
from time ~o time, the Clerk-Treasurer is hereby authorized and
empowered to establish and disburse from a special sewer check-
ing account in the Onion State Bank in which account sha~l be
deposited all receipts, income, contributions from Federal Aid
Funds,and revenue derived from sanitary sewer servi~e to be pro-
vided to the recently annexed portions of the Town of Carme~,
which sewage system is being constructed b~ the Keystone Square
Company under contract with the Town of Carmel and from which
account the Clerk-Treasurer shall be authorized by the Board from
time to time to disburse funds to meet the Town's financial com-
mitments conc~ming purchase, operation, maintenance of such sew-
~Ee system. The President of the Board of T~ustees is authorized
to deposit such funds on interest in accordance with similar
authority granted by previous resolution of the Boar~.
Fire Chief 8wails presented a report fo~ the second quarter of
1967. He also presented information in regard to a pension plan.
Due to complaints,he was requested to shorten the length of time
the siren would blow.
Police Chief Beard presented his repor~ for June which ~as. adopted
Mr. Beard was requested to ask the V. F organization to con-
tac~ thebusiness men in Carmelin regard ~o assistingin repaving
sidewalks in ~he ~usiness area.
