The proposed project shall dedicate 50 foot half right of way on Hazeldell Road per the Thoroughfare Plan. All interior streets shall be 30 feet of pavement with 50 feet of right of way except for cul-de-sacs, which shall have 26 feet of pavement. Stub streets are proposed to the north, west and south along existing subdivisions. Sanitary — Sanitary service shall be provided by the City of Carmel. Sewers presently exist in Aston Subdivision, Hazeldell Road, and Valleybrook Subdivision. Connection to an offsite interceptor is anticipated. School - Request for services report has been forwarded to Carmel/Clay Schools. Water - Carmel Water Company will supply water service to the project. Bucher Director of Community Development 40 East Main Street Carmel, IN 46032 RE: Avian Glen Primary Plat Utility Reports Dear Wes: Water System - The proposed water system for Avian Glen is intended to provide service to each lot in the subdivision via water mains along the right-of-way of the proposed streets. The system will be primarily an 8 inch main connected at three existing locations. One connection will be at the western limits of Avian Glen Section One (under construction) , a second connection will be along the west property line at Valleybrook Subdivision and a third connection will be made near the southeast corner of the tract to an existing 12 inch main along the west side of Cherry Tree Road. Within the subdivision, 8 inch mains will be internally looped with 6 inch mains serving the proposed cul-de-sacs. Fire hydrants and valves will be provided at locations consistent with the requirements of the City of Carmel. Water service will be ." provided by the City of Carmel Utilities Department. Sanitary Sewer System - The sanitary sewer system for Avian Glen is intended to provide gravity sewer connection to each lot. Treatment of sanitary waste will be by the City of Carmel. The sewers onsite will be designed and constructed in accordance with the requirements of the City of Carmel and the State of Indiana. It is anticipated that 8 inch pVC sewer will be utilized and will discharge at the southwest corner of the tract to a proposed sanitary sewer interceptor. The proposed interceptor is anticipated to be constructed along the south and west side of the Michener Legal Drain continuing to a connection with an existing sanitary sewer located along the south side of 131st Street. Detention of developed stormwater will be provided in two lakes located onsite. The discharge from the detention facilities will be to the Michener Legal Drain and will be in accordance with local drainage requirements. In general, the developed discharge under 100 year 24 hour storm conditions will be restricted to the peak discharge under predeveloped 10 year 24 hour conditions. All homeowners are to be encouraged by their builders to participate in the Backyard Habitat Program as sponsored by the Indiana Wildlife Federation. 2 . "Tree Preservation Areas" means those areas of ground so designated on the Construction Plans of Avian Glen. The developer reserves the Tree Preservation Area for the preservation of trees located within and upon such areas and for the use of Developer during the Development Period for access to and for planting and replacement of trees, bushes, shrubbery, other vegetation providing landscape screening and other improvements . Trees of four (4) inch caliper or larger within any Tree Preservation Area shall not be removed without the prior written consent of the Architectural Review Committee; provided, however, that the written consent of the Committee shall not be required for removal of such trees (a) by public utility companies, governmental agencies, Developer, the Department of Public Works of the City of Carmel or the Association in connection with any such entity' s use of the Drainage Utility and Sewer Easements as herein permitted; or (b) by Developer or any builder in connection with the initial Construction of a residence on a Lot if such trees are located within the foot- print of the residence or any driveway, accessory building and other improvement to be constructed by the Developer or the builder on the Lot. The Owners of Lots in the Subdivision subject to a Tree Preservation Area shall take and hold title to the Lots subject to the Tree Preservation Area requirements. 3 . A tree preservation plan is to be submitted to the City of Carmel for approval prior to the development of each section, which plan shall identify areas of trees to be preserved as indicated in Article 2 above. 4. As each section is platted, all landscaping in the common areas of that section shall be completed by the end of the first planting season, the start of which occurs after the start of development. 5. The project is located in the southeast quarter of Section 21, Township 18 north, Range 4 east, in Hamilton County, Indiana, We have reviewed the information submitted in accordance with Section 404 of the Clean Water Act (CWA) under which the U.S. Army Corps of Engineers regulate the discharge of dredged and fill material in "waters of the United States" including wetlands . Based on the data provided it appears that the project may involve such discharges since the site does contain 0.92 acre of jurisdictional wetlands. The discharge of dredged or fill material in the above-mentioned wetland area is authorized under the provisions of Nationwide general permit 33 CFR Section 330.5(a) (26) . This Nationwide general permit eliminates the need for further processing for discharges which affect less than 1 acre of the waters or wetlands which are isolated or located above the headwaters . The term "headwater" is defined as the point on a non-tidal stream above which the annual flow is less than 5 cubic feet per second. The only requirement is that the person responsible for the project must ensure that the work complies with enclosed Special Conditions and best management practices , You are advised that should the total project involve the loss or substantial adverse modification of 1 to 10 acres of the above-mentioned wetlands, notification to this office is required. This means that an application and plans of the proposed work must be submitted and approved before the work is done. We have enclosed an application packet should you determine the project would impact more than 1 acre of jurisdictional wetlands. Byers COOK & BYERS 72 South Ninth Street • Noblesville, IN 46060 RE: Carmel Plan Commission ads Dugan Dear Gordon: The purpose of this letter is to memorialize a portion of our conversation in our meeting held today, April 17 , 1991 regarding the above-referenced case. Specifically, I would like to outline to you my understanding as to the agreement reached that will prompt you to dismiss this case. The specifics of the understanding are as follows : 1 . You would dismiss your case, with prejudice, contingent upon the Board of Public Works approval allowing you to install a temporary culdesac, wherein the culdesac would be built on a portion of Lot 47 . You will give written assurances to the Board of Public Works that if this particular street is to join with the subdivision abutting this property, you will allow a through street to be completed. In this respect, you would maintain the present right-of-way that is dedicated to the city for that extension. Additionally, a performance bond would be posted that would include provisions for the payment of the costs necessary to complete the through street from your subdivision to the new one. Your client will also, in writing, give assurances to the Board of Public Works, that if requested by the Board of Public Works or the City, that the curbs will be removed and relocated so that the street does not have a buldge at the former location of the culdesac when the through street is constructed. 2 . You indicated that you would amend the plat plan to show Lot 47 was to have an extension of the building line reflecting the fact that the culdesac spills over onto its property. ONE CIVIC SQUARE/COUNCIL CHAMBERS The meeting of the Carmel Board of Public Works and Safety was called to order by Mayor Dorothy J. Hancock. Members Billy Walker and David Taylor were in attendance. Also in attendance was City Attorney Steve Andrews and Clerk-Treasurer Susan W. Jones. MINUTES OF MAY 6, 1991: Mayor Hancock moved to approve the minutes of May 6, 1991. The motion was seconded by Billy Walker. All -*members voted aye. Motion carried. CLAIMS: A motion was made by Walker and seconded by Hancock to approve claims, pages 1-13 , dated May 9 , 1991 in the amount of $4 , 610, 747 . 28 . All members voted aye. Motion carried. A motion was made by Walker and seconded by Hancock to approve claims, page 1, dated May 14 , 1991 in the amount of $1, 500 . 19 . All members voted aye. Motion carried. The mayor added a claim for approval. The claim was for a registration fee of $80. 00 for a spring leadership conference fee for the Mayor. The mayor stated if it was paid tomorrow, the City would save $20 . 00 . The mayor said it was a claim to the Indiana Association of Cities and Towns. Walker asked if this conference was for mayors. Hancock replied yes. Walker then asked if the mayor elect should not also attend the same conference. Hancock stated this conference is a leadership conference to set out what is going on for the next year for IACT. Walker moved to approve this claim and it was seconded by Hancock. All members voted aye. Motion carried. BIDS/STREET DEPARTMENT: The clerk-treasurer stated all bids were received by 5 : 15 p.m. POLE BARN: Clearly Building Corporation 423 B West South Street Lebanon, Indiana 46052 $22 , 570 k-3 them. Andrews wanted to get them all taken care of at once. Walker moved to do that procedure as set out by Andrews and look at 1 any other property that the City might have that would come under that procedure and make sure they are all incorporated. Taylor seconded the motion. All members voted aye. Motion carried. CONSTRUCTION OF CUL DE SAC ON NORTH END OF LOT 47, SECTION 2, VALLEYBROOK SUBDIVISION: The mayor stated it was Andrews ' opinion that this item did not require any action from the BPW but only needed an update. Andrews stated that Gordon Byers had negotiated a resolution with Bill Wendling of this matter. Andrews said there was some litigation filed regarding the cul de sac. Byers said he has also filed to do a double cut into this particular home (Lot 47) and it was his understanding through the Department of Community Development wanted them submitted to the 4B1014. Walker moved to approve the double cut for this property. The motion was seconded by Taylor. All members voted aye. Motion carried. REQUEST FOR OPEN CUT IN HAZEL DELL ROAD FOR STORM SEWER/STAN NEAL- WEIHE ENGINEERS: Stan Neal of Weihe Engineers on behalf of Ashton Subdivision requested permission to make an open cut in Hazel Dell Road for storm sewer construction on May 21, 1991 between the hours of 9 : 30 a.m. and 1: 30 p.m. The construction should take approximately 3 to 4 hours. The mayor asked Welch if there were not already established rules as far as signs and things like that were concerned on projects such as these. Welch replied yes. David Cunningham asked that the cut and construction be done after school or at least during the time of day when the children are in school. Walker so moved but directed Neal to notify the Carmel Police and Fire Department and let them know the plan for construction. The motion was seconded by Taylor. All members voted aye. Motion carried. DEDICATION OF RIGHT-OF-WAY/11711 NORTH GRAY ROAD/DR. & MRS. DASHIELL: Jim Nelson, attorney for the Dashiells, presented the BPW a dedication of public right-of-way representing a part of two parcels of real estate recently purchased by them from American Aggregates Corporation and lying both north and south of the real estate owned by them and commonly known as 11711 North Gray Road.
