Bucher Director of Community Development 40 East Main Street Carmel, IN 46032 RE: Avian Glen Primary Plat Utility Reports Dear Wes: Water System - The proposed water system for Avian Glen is intended to provide service to each lot in the subdivision via water mains along the right-of-way of the proposed streets. The system will be primarily an 8 inch main connected at three existing locations. One connection will be at the western limits of Avian Glen Section One (under construction) , a second connection will be along the west property line at Valleybrook Subdivision and a third connection will be made near the southeast corner of the tract to an existing 12 inch main along the west side of Cherry Tree Road. Within the subdivision, 8 inch mains will be internally looped with 6 inch mains serving the proposed cul-de-sacs. Fire hydrants and valves will be provided at locations consistent with the requirements of the City of Carmel. Water service will be provided by the City of Carmel Utilities Department. Sanitary Sewer System - The sanitary sewer system for Avian Glen is intended to provide gravity sewer connection to each lot. Treatment of sanitary waste will be by the City of Carmel . The sewers onsite will be designed and constructed in accordance with the requirements of the City of Carmel and the State of Indiana. It is anticipated that 8 inch pVC sewer will be utilized and will discharge at the southwest corner of the tract to a proposed sanitary sewer interceptor. The proposed interceptor is anticipated to be constructed along the south and west side of the Michener Legal Drain continuing to a connection with an existing sanitary sewer located along the south side of 131st Street. Detention of developed stormwater will be provided in two lakes located onsite. The discharge from the detention facilities will be to the Michener Legal Drain and will be in accordance with local drainage requirements. In general, the developed discharge under 100 year 24 hour storm conditions will be restricted to the peak discharge under predeveloped 10 year 24 hour conditions. The proposed project shall dedicate 50 foot half right of way on Hazeldell Road per the Thoroughfare Plan. Amendment to COMPREHENSIVE PLAN UPDATE City of Carmel/ Clay Township 1990 is a divided highway designed to have full control of access, with no traffic crossing at-grade and provides for the movement of high-speed traffic access or service to abutting property. Expressways: Expressways are arterial highways for through traffic, whose main purpose is to move traffic rather than to provide access to individual properties. An expressway is a divided highway with full or partial control of access and a limited number of at-grade intersections. An expressway may be of various types: a facility entirely at-grade; a facility with frontage roads that have controlled-access features and terminated crossroads; or a facility that has an occasional at-grade intersection. Primary Arterials: Primary arterial carry both local and cross-county traffic, link various communities and settlement clusters and move traffic to and from such major traffic generators as employment centers, shopping centers, the downtown area, and other similar traffic generators. Primary arterial carry both intermediate and longer distance traffic, extensively utilizing traffic control devices to facilitate traffic flow within urban/developed areas. Regulations of "curb" cuts is often necessary. Secondary Arterial: Secondary arterial are intended to collect and distribute traffic to primary arterial. Secondary arterial provide service to specific traffic destinations, allow easy movement from one neighborhood to another within the same part of an urban area, and provide crosstown traffic movement. A secondary arterial is similar to a primary arterial with respect to collecting and distributing traffic, except that a secondary arterial serves smaller traffic-generating resources such as community-oriented commercial areas, primary and secondary schools, major recreation areas, churches and other similar land uses. Collector Streets: Collector streets take traffic from the local access streets, carry over a short distance and distribute it to secondary and primary arterial, so the traffic can then move to its destination. As the name implies, a collector street serves the primary purpose of "collecting" local traffic and delivering it to the next higher-order street. Local Streets: Local streets are intended to provide access from the arterial and collector roadway system to individual properties. They also provide additional right-of-way for placement of utility lines, drainage and sewer facilities and on-street parking. Local access streets should be designed to discourage throw h traffic between neighborhoods. In the 1990 Amendment, the 'local' designation replaces the previous 'local access-residential' and 'local access-commercial' classification. Parkways: Parkways represent a special classification of arterial roadway. A parkway is a divided roadway with special landscape treatments within the median and along the edges of the roadway. Easements for off-site drain are being negotiated. They will be in place prior to proceeding with the secondary plats. 2 . A soils map has been enclosed and also sent to John South along with a letter from the army corp of engineers regarding the wetlands. A note defining subsurface drains to each lot as been added to the plat. The exact locations will be defined on the final construction plans. The off-site watershed form Langstons pond has been determined to be approximately 2 .3 acres. This runoff will be routed into our storm pipe system. The off-site watershed has been added to the plat. 3 . Another copy of the water and hydrant layout has been reviewed with Stan Pucket. I will follow up with him to obtain an approval letter. 4 . Annexation of the east half of Hazeldell Road will probably happen prior to our starting construction. If it has not we will proceed with obtaining permits from the county highway department. 5 . We feel that we have complied as best we could with the comprehensive plan by providing the connection to Valleybrook. The street width remains at 30 feet with 50 feet of right-of-way which is consistent with the existing streets in Valleybrook. This annexation would include not only the plated area, but also the entire Right-of-Way of Hazel Dale Road and Cherry Tree Road from the northern most boundary of this plat to the southern most boundary of this plat. Since this development will be in the city, we will require that the streets be built to City of Carmel standards. We will also require Hazel Dale Road and Cherry Tree Road to be improved. If this sewer is to run within the statutory limits of the regulated drain, the petitioner will be required to provide proof that all applicable permits have been obtained and that all fees have been paid to the County Drainage Board to construct this sewer within the easement. The project is located in the southeast quarter of Section 21, Township 18 north, Range 4 east, in Hamilton County, Indiana. We have reviewed the information submitted in accordance with Section 404 of the Clean Water Act (CWA) under which the U.S. Army Corps of Engineers regulate the discharge of dredged and fill material in "waters of the United States" including wetlands . Based on the data provided it appears that the project may involve such discharges since the site does contain 0. 92 acre of jurisdictional wetlands. The discharge of dredged or fill material in the above-mentioned — wetland area is authorized under the provisions of Nationwide general permit 33 CFR Section 330.5(a) (26) . This Nationwide general permit eliminates the need for further processing for discharges which affect less than 1 acre of the waters or wetlands which are isolated or located above the headwaters. The term "headwater" is defined as the point on a non-tidal stream above which the annual flow is less than 5 cubic feet per second. The only requirement is - that the person responsible for the project must ensure that the work complies with enclosed Special Conditions and best management practices. You are advised that should the total project involve the loss or substantial adverse modification of 1 to 10 acres of the above-mentioned wetlands, notification to this office is required. This means that an application and plans of the proposed work must be submitted and approved before the work is done. We have enclosed an application packet should you determine the project - would impact more than 1 acre of jurisdictional wetlands. Failure to comply with this requirement would result in a violation of Section 301 of the Clean hater Act. You would dismiss your case, with prejudice, contingent upon the Board of Public Works approval allowing you to install a temporary culdesac, wherein the culdesac would be built on a portion of Lot 47 . You will give written assurances to the Board of Public Works that if this particular street is to join with the subdivision abutting this property, you will allow a through street to be completed. In this respect, you would maintain the present right-of-way that is dedicated to the city for that extension. A motion was made by Walker and seconded by Hancock to approve claims, page 1, dated May 14 , 1991 in the amount of $1, 500. 19 . All members voted aye. Motion carried. The mayor added a claim for approval. The claim was for a registration fee of $80. 00 for a spring leadership conference fee for the Mayor. The mayor stated if it was paid tomorrow, the City would save $20 . 00 . The mayor said it was a claim to the Indiana Association of Cities and Towns. Walker asked if this conference was for mayors. Hancock replied yes. Walker then asked if the mayor elect should not also attend the same conference. Hancock stated this conference is a leadership conference to set out what is going on for the next year for IACT. Walker moved to approve this claim and it was seconded by Hancock. Taylor offered a second to the motion but with an amendment to the second paragraph. Taylor wanted the word "contract" changed to "proposal". All members voted aye. Motion carried. RIGHT-OF-WAY-ACOUISITION/14339 HAZEL DELL ROAD/MARK & LINDA CALLAHAN: Mayor Hancock said the minutes of the last meeting called for a diagram to look at the overall project. City Engineer, Tom Welch confirmed that the septic system would be within the right-of-way. The mayor asked the engineer that since a sewer was being brought in for the new subdivision and it would be brought up to the property line of this particular property in question, that if the sewer is within 300 feet the owner, doesn't the owner have to hook-on. Welch replied yes. Hancock said nothing is being changed by this project. No more right-of-way has to be acquired unless the sidewalks are done but for the street project, there is ample right-of-way. Welch explained the only problem with this project is if the City wants to do sidewalks then more right-of-way needs to be acquired and there will be one of Callahan' s trees involved at that time. The mayor stated that at this time, the City has not requested any additional right-of-way of Callahan. Callahan stated he did want sidewalks. Andrews said he was willing to talk with all the parties involved on the acquisition of right- of-way for sidewalks but didn't feel Callahan' s request was appropriate to be brought before the Board of Public Works. Walker moved to direct Andrews to get into direct conversation with ,_ Welch and Callahan and if there is any problem to bring it back before the Board but that it be removed from the agenda until that time. Taylor seconded the motion. All members voted aye. Motion carried. PROPERTY TAXES/RANGE LINE ROAD: The mayor asked the clerk- treasurer if it had been determined if these taxes could be paid from the drainage assessment line item in the budget. The clerk replied yes. The mayor asked the clerk if the claim had been submitted for payment. The clerk replied yes. Walker moved to pay the property taxes on this property. No second or vote was taken on this motion. Walker asked Andrews if it was true that the City doesn't have to pay property taxes. Andrews stated that a form needs to be completed at the county auditor's office. Andrews said the form was to be sent to the clerk' s office. Andrews said it has been done on some of the properties the City owns but not on all of them. Andrews wanted to get them all taken care of at once. Walker moved to do that procedure as set out by Andrews and look at any other property that the City might have that would come under that procedure and make sure they are all incorporated. CONSTRUCTION OF CUL DE SAC ON NORTH END OF LOT 47, SECTION 2, VALLEYBROOK SUBDIVISION: The mayor stated it was Andrews ' opinion that this item did not require any action from the BPW but only needed an update. Andrews stated that Gordon Byers had negotiated a resolution with Bill Wendling of this matter. Andrews said there was some litigation filed regarding the cul de sac. Byers said he has also filed to do a double cut into this particular home (Lot 47) and it was his understanding through the Department of Community Development wanted them submitted to the BPW. Walker moved to approve the double cut for this property. The motion was seconded by Taylor. All members voted aye. Motion carried. REQUEST FOR OPEN CUT IN HAZEL DELL ROAD FOR STORM SEWER/STAN NEAL- WEIHE ENGINEERS: Stan Neal of Weihe Engineers on behalf of Ashton Subdivision requested permission to make an open cut in Hazel Dell Road for storm sewer construction on May 21, 1991 between the hours of 9 : 30 a.m. and 1: 30 p.m. The construction should take approximately 3 to 4 hours. The mayor asked Welch if there were not already established rules as far as signs and things like that were concerned on projects ,�- such as these. Welch replied yes. David Cunningham asked that the cut and construction be done after school or at least during the time of day when the children are in school . Walker so moved but directed Neal to notify the Carmel Police and Fire Department and let them know the plan for construction. The motion was seconded by Taylor. All members voted aye. It is our understanding that this development will be annexed to the City of Carmel. This annexation would include not only the plated area, but also the entire Right-of-Way of Hazel Dale Road and Cherry Tree Road from the northern most boundary of this plat to the southern most boundary of this plat. Since this development will be in the city, we will require that the streets be built to City of Carmel standards. We will also require Hazel Dale Road and Cherry Tree Road to be improved. Those improvements may include, but not be limited to widening, wedging, and resurfacing. The interior streets should connect to all existing stub streets in the adjoining subdivisions. These connections should be accomplished at the time of construction of the subdivision section. Since the storm sewer discharges into a county regulated drain, we will defer to the County Surveyor for approval of the storm drainage system. Availability of sanitary sewer and potable water will require Carmel Board of Public Works approval. There is a significant off-site sanitary sewer that needs to be constructed with this development. The petitioner needs to provide the City of Carmel with recorded easements sufficient to install and maintain this interceptor.
