Guidelines For Builders and Homeowners
Avian Glen Subdivision
Carmel , Indiana
1 . All homeowners are to be encouraged by their builders to
participate in the Backyard Habitat Program as sponsored by
the Indiana Wildlife Federation.
2 . All trees and vegetation designated to be preserved,
with the exception of building areas , shall not be removed
by an individual home owner after his/her occupancy without
prior written consent of the Avian Glen Association, Inc.
3 . In regard to any trees preserved on site by other
developer which are not in lot easements , building pads or
access pathways , the builders are not allowed to remove such
trees.
4 . As each section is platted, all landscaping in the
common areas of that section shall be completed by the end
of the first planting season, the start of which occurs
after the start of development.
5. Each builder is to plant a minimum of 2 trees as close
as is possible next to the Right of Way boundary. These
trees are to be evenly spaced parallel to street. The
developer, in cooperation with the Builders , will designate
the type of trees to be planted in such fashion for each
street so that there is a visual continuity to the proposed
streetscapes .
6 . A tree preservation plan is to be submitted to the City
for approval prior to the development of each section, which
plan shall identify areas of trees to be preserved as
indicated in Articles 1-5 above.

Dear Mr. Bucher:
The following agreement shall be considered part of the final
plat application:
The developer shall be responsible for any drainage problems
including standing water, flooding and erosion control, which
arise or become evident at any time during the three year
maintenance period after release of subdivision bonds, and which
is attributable to a deficiency in subdivision drainage design or
construction of drainage improvements. This shall include all
pipes, structures, swales, ditches and ponds which are pertinent
features to the property drainage of the subdivision.
This responsibility of the developer shall not, however, include
problems which are created, subsequent to the completion of the
subdivision improvements by the improper grading by individual
builders, or structures and improper grading installed or
accomplished by individual homeowners.
It is the intent of this requirement, that the developer shall,
specifically, provide such subsurface drains, or storm sewers or
ditches as are required to properly rectify any drainage problem
or subsurface water problem which was not contemplated in the
original approved subdivision design, including, but not
restricted to, disposal of subsurface water from footing drains
or individual lots.

out to the potential Avian Glen Builders. The response this past
week has been very good. We presently have twelve builders
signed up with several others ready to sign. We have also sent a
similar package out to 900 realtors in the Carmel area to inform
them of the project. Advertising in the Carmel and Indianapolis
papers will start this week. I will be in next week to obtain a
temporary sign permit to be located on Cherry Tree Road. If you
or anyone else has any questions regarding our project status

Re: Avian Glen Updated Landscaping Plans
Dear Chris,
Upon review of your updated Landscape Plan, I feel that this is a great
improvement over the previous plan. I would ask that you confirm that the site vision
triangles are not going to be hindered and that the uplights along the fence be
screened with landscaping, so they cannot be seen from the street.
I will add this to the Avian Glen File and accept this letter as written approval of
the changes.
On a related subject, the erosion control measures need to be incorporated as
soon as possible at the Avian Glen site.

Amended Signage and Landscape Plan
Dear Dave:
As part of the original approval for this project we submit-
ted details of your landscaping and entrance signage for your
review. We have recently revised and expanded the proposed
landscaping and entrance wall features for this site. Enclosed
please find a copy of the original approved plan and two copies
of the proposed plan for your review and approval. I believe you
will find the new plan a great improvement. We have also added
some up-lighting of the major trees along Cherry Tree frontage
and up-lighting on the brick column and walls.

Avian Glen project ( see attached sketch for location ) as follows :
Waters 220 E. D. U. ' s as per Water Ordinance A-54 Sec. 4. 03.
Not to exceed an average daily flow of 66, 000 gallons.
Sewer : 220 E. D. U. ' s as per Sewer Ordinance S-41 Chapter 7.
Not to exceed an average daily flow of 66, 000 gallons.
Construction or development of the above project must begin within

Dear Board Members :
It has been the Board 's policy to allow islands at entrances to
subdivisions if the following criteria is met :
1. Travel lanes on either side be a minimum of 18 ' width.
2. No private drives exiting onto divided portion of
pavement.
3. No entrance signs to be located on island.
The south entrance at Telford Parkway and Cherrytree Avenue meets
the above provisions, contingent on not allowing driveways on Lots
#218, 219, 220, 1, and 2 exit onto the divided portions of Telford
Parkway.
At the north entrance at Telford Parkway and Cherrytree Avenue, the
island should be shortened or moved east toward Cherrytree Avenue
to allow for a driveway for Lot #145. Lot #144 should be required
exit onto Warbler Circle.
If the Board agrees with the recommendations, they can be enforced
at the time the Board of Public Works approves and signs the
Secondary Plat.
The Board should request that the Covenance for this subdivision
include the maintenance of these islands if they are to be
landscaped. This would be consistant with others the Board has
approved, such as Asthon and Carolina Commons.
The drainage does not need to be addressed by the Board since it
flows into the legal drain and will require County Drainage Board
action.
This project will require some off-site sewer construction. They
will apprear at a future date for a Reimbursement Agreement before
construction begins.

In response to our conversation on December 4, 1990, I consulted with Kent Ward
concerning the retention for the site and the sanitary sewer within the Mitchner Ditch
easement. The calculations need to indicate how the Fremont Randall drainage area was
restructured. I understand that a portion of that runoff will be diverted south to a
detention area before it is released into the Mitchner Ditch. This change should
cause the runoff for. the Randall area to be at or below the allowable 10 year rate.
When these plans are completed, please send me a copy, along with the
corresponding calculations. This will need to be done before the County Surveyor will
approve a tie-in to the regulated drains.
Concerning your questions about the sanitary sewer within the Mitchner Ditch
easements, approval to work in the regulated drain must be approved by the Hamilton
County Drainage Board. Also, the regulated drain easement does not include an
easement for the sanitary sewer. Therefore, that will need to be obtained from the
landowner.

I have reviewed the construction plans for this project and have the fol-
lowing comments.
1 . In the long run, when the entire subdivisions drainage facilities are
installed, the c.f.s. flowing into the Fremont Randall drain will be
less than the current amount. However, until the other sections are
developed, how will you temporarily retard the water from the south-
west?
2. Please show the interception of the Fremont Randall Drain along the
southern boundary of section one.
3. Submit the petition for the reconstruction and relocation of the Fremont
Randall Drain.
4. Where the Fremont Randall Drain is relocated the easement should show
15' to conform with IC 36-9-27-33(e) .
5. A letter requesting permission to tie-in to the Fremont Randall Drain
needs to be sent in addition to the above mentioned petitions.
6. If grades will permit, we recommend that inlet 712 employ a beehive
inlet instead of an open-ended inlet.
7. Flood routing should be addressed.
8. Please show pipe type and length.
9. Will there be foot access to the school from this section?
10. We recommend SSD in swales with less than 1% slope.
11 . Final approval of regulated drain reconstruction and relocation is the
responsibility of the Drainage Board based upon the Surveyors recommen-
dation. Tie-in requests may be approved by the Surveyor.

After reviewing the above referenced plat and plans, we have
the following requirements:
Secondary Plat
1) Supply all right of way corner radii.
2) A copy of the covenants are needed.
Review of Construction Plans
1) Provide island details and dimensions.
2) Provide stipulation that Woodfield Drive South must be
connected in a satisfactory manner.
3) Provide curb return radii for all curbs.
4) SSD needs to be 6" .
5) Swale detail attached - swale needs to be indicated on
plans along Hazeldell Road - detail ST1 needs to reflect
this.
6) Entrance detail required - showing Hazeldell Road
improvements: accel and decel lanes, passing blister,
widening, and pavement thickness.

7) An Inspection Agreement is required between the developer
and the County.
8) Three sets of revised plans shall be submitted for
approval to the Hamilton County Highway Engineer.
If necessary, other items will be addressed after receiving
the revised prints. The Hamilton County Highway Department will
waive these requests if a copy of the annexation ordinance is
forwarded to us. If you have any questions, please contact Steve

across this property.
2 . Lot widths area noted at the building line wherever
necessary to ensure 120' frontage.
3 . Entrance signage and landscaping easements are shown.
4 Island in Webster Drive is now shown as a Block.
However, some discussion should occur concerning
maintenance and dedication of this Block.
5. Address and telephone of developer has been added to
plat.
6. Surveyor's seal has been placed on the plat.
7 . Source of title, referenced by Deed Book and page
number is shown.
8 . Curve notes have been completed and shown.

With regard to other questions or suggestions, we have the
following comments.
41) An access point, via easement and accompanying sidewalk,
to the school will not be provided at this time. There
are issues of liability and maintenance that are
difficult to resolve concerning this.
B. Irregular easements have been further delineated.
C. Improvements to Hazeldell Road will be acell/decel lanes
and a passing blister along the east side. We are
anticipating matching existing pavement, as this section
of road has been recently improved.
D. Webster Drive ROW has been further dimensioned to more
clearly show location.
E. Proposed landscape and signage plan is included
herewith.
F. Drainage calculations have been submitted to SCS,
Surveyor's Office and City Engineer.

The above mentioned subdivision is coordinated with the
Comprehensive Plans as follows:
Thoroughfare Plan- The proposed project connects with Hazeldell
Road on the east side and Valleybrook on the west. The proposed
project shall dedicate 50 foot half right of way on Hazeldell
Road per the Thoroughfare Plan. All interior streets shall be 30
feet of pavement with 50 feet of right of way except for
cul-de-sacs, which shall be 26 feet of pavement. Stub streets
are proposed to the north, west and south along existing
subdivisions.
Sanitary - Sanitary service shall be provided by the City of
Carmel. Sewers presently exist in Aston Subdivision and
Hazeldell Road.
School - Request for services report has been forwarded to
Carmel/Clay Schools.
Water - Carmel Water Company will supply water service to the
project.

Drainage - Plans for stormwater management will be prepared by a

sanitary service to the project. An average daily flow from this
project will be 28 lots at 310 gal. /day (8 , 680 GPD) . A sewer
allocation has been obtained from the Board of Works.
Storm Drainage System - The project is initially designed with
storm sewers and open swales. The detention system shall be
designed for a proposed 100 year developed runoff with a
discharge at a 10 year return storm runoff rate under the
existing development. The drainage system has been previously
approved by the County Drainage Board.
