Dear Potential Builder:
We ' re writing to bring to your attention the opening of
brand new custom home community in Carmel to be called Avian Glen
and to invite you to participate in the new community as a build-
er. Avian Glen is being developed by a partnership called Avian
Glen Associates , which is managed by Davis Development , Inc .
Since 1986, Davis Development, Inc. has overseen the development
of approximately 1, 800 lots in fourteen communities in the Indi-
anapolis metropolitan area. Avian Glen will be the company ' s
first community in Carmel with lots designed for sale exclusively
to Carmel custom builders.
Avian Glen is located within the Carmel city limits near the
new Cherry Tree Elementary School on the west side of Cherry Tree
Avenue, north of 131st Street and south of 146th Street . When
fully developed, Avian Glen will have internal street connections
to the existing Valleybrook community to the west and Woodfield
to the north. The Avian Glen site is also near the popular retail
center at the corner of 126th Street and Gray Road and Village
Park Plaza on North Meridian Street . The Carmel Dad ' s Club and
Carmel Middle School are located approximately one mile south of
the Avian Glen site near the intersection of 131st Street and
Cherry Tree Avenue.
Avian Glen will contain a total of approximately 200 home
sites and will be developed in four separate phases . A substan-
tial portion of the site is very heavily wooded. In addition, two
lakes will be constructed during the initial phase of develop-
ment. Some of the lots in the community will actually back up to
the tree line surrounding the Cherry Tree Elementary School, and
internal sidewalks and pedestrian walkways will be designed to
allow children to walk directly to school without having to leave
the subdivision. In the second phase of development, an amenity
area consisting of a community swimming pool and clubhouse will
be built and made available exclusively to Avian Glen residents .

The prices of lots in the first phase will start at $36, 000
and go up as high as $47 ,500 for densely wooded cul-de-sac lots.
Of the 58 lots contained in the first phase, approximately 15%
are heavily wooded, 35% are lake lots and 10% are located on cul-
de-sacs . The typical lot dimensions will be 120 ' wide by 150 '
deep. Of course, all lots will be served by public utilities ,
including Carmel sewer and water. Based on the market studies and
appraisals prepared for the new project and discussions with
brokers knowledgeable of the Carmel market, we believe that Avian
Glen will be very successful if homes in the community can be
priced to fit within the $190, 000 to $250, 000 range.
Avian Glen will not be set up as a "closed" builder communi-
ty. However, we do not intend to sell any lots directly to indi-
vidual homebuyers. Instead, homebuyers will be required first to
select a participating builder and then purchase their desired
lot through that builder. Builders interested in participating in
Avian Glen will be asked to make a $10, 000 advance cash deposit
to the development partnership. One-half of this deposit will be
credited against the second lot purchased by the builder and the
remaining one-half will be credited against the third lot pur-
chased. Participating builders will be able to reserve lots by
phone for 30 days, and will be allowed to have up to three lots
on reserve at any one time. No additional deposit or other com-
mitment will be required to reserve a lot. If a builder calls to
reserve a lot which another builder has already put a hold on,
our community coordinator will take second (or even third) reser-
vations which would become effective if the builder with the
prior reservation elects not to purchase.
After the 30-day reservation period, builders will be asked
either to release their reservation or enter into a binding pur-
chase agreement for the lot and proceed to a closing within 45
days after the agreement is signed. For lot purchase agreements
entered into after the initial $10 , 000 deposit has been fully
credited ( i.e. , after the third lot purchased by the builder) ,
the normal deposit equal to 10% of the purchase price would be
put down at time of signing and would be credited against the
purchase price 45 days later at closing . During a builder ' s
association with the community, it would be asked at all times to
have at least one home actively under construction or at least
one finished spec home available for sale.
The plat covenants and restrictions for Avian Glen will
provide for the normal system for prior architectural review and
approval of builder house plans . In this regard, we will be
establishing a procedural system which allows these reviews and
approvals to be done in the quickest and most efficient manner

possible in order to avoid delays and minimize any other incon-
venience to the builders . During the development and building
period, all of the trash pick-up, street cleaning and other main-
tenance on lakes, entrances and other common areas at Avian Glen
will be performed by crews of trained maintenance personnel who
work directly for the developer.
With a view to making it as easy as possible for homebuyers
and builders to obtain financing for the homes in Avian Glen, we
have arranged for First Centennial Financial Corporation to offer
its new "All-in-One" construction financing package on an exclu-
sive basis to Avian Glen buyers . Under this program, a contract
buyer completes the mortgage application process and closes on
the loan before construction of the home begins. As soon as the
loan closes, it is available to fund construction costs, includ-
ing the cost of the lot. First Centennial will offer this package
to Avian Glen buyers for only one-half of the normal 1% origina-
tion fee. The key advantages to the builder are that (i) the loan
is actually in the name of the buyer and the buyer pays all
financing costs, ( ii) the builder draws on the loan to finance
the purchase of the lot and the construction of the home without
having to use his regular line of credit and (iii) there is only
one loan closing and it takes place before construction begins so
that the buyer cannot cancel or back out of its contract with the
builder during the construction period. The "All-in-One" package
also has obvious advantages to buyers and to any brokers involved
in a sale ( since they are able to receive their full commission
prior to commencement of construction) . Additional information on
this program is contained in the enclosed Avian Glen community

Construction is well underway at Avian Glen, and so far work
is proceeding ahead of schedule. As part of the development work,
the section of Cherry Tree Avenue from the Avian Glen entrance
down to 131st Street will be repaired and completely resurfaced.
We expect to have finished lots available for home construction
in late August or early September. Local advertising for the new
community will begin in the second week of July.
As stated above, no lot sales will be made directly to
individuals. This means that our office will essentially act only
as a community information source and builder referral service to
prospective homebuyers who call to inquire about Avian Glen. We
would very much like to include you as an Avian Glen participat-
ing builder . The name of each participating builder will be
included in the builder list contained in the Community Informa-
tion Packages mailed out to brokers and interested homebuyers.

Based on all of the market research we ' ve done and the
strong expressions of interest we 've received to date, we believe
that Avian Glen will be a success. The $190, 000 to $250, 000 price
range continues to be very strong in the Carmel market and the
Avian Glen lot prices are designed to allow builders to offer
homes in that range.
We are in a position to begin accepting deposits from inter-
ested builders as early as next week. Once the initial deposit is
made, a builder may immediately begin reserving individual lots
to take them off the market until the grand opening date for the
community scheduled for late August or early September. We will
try to contact you within the next week to determine whether you
might have an interest in building at Avian Glen. Meantime, if

Summary of Plat Covenants and Restrictions
Set forth below is a general summary of the plat covenants
and restrictions relating to the lots in Avian Glen. To obtain
copies of the full set of covenants and restrictions or to ask
questions regarding the summary information, please feel free to
contact the Avian Glen Associates Director of Sales and Community
Coordinator at 259-6213 .
* Designated common areas will be owned and maintained by
the Avian Glen Homeowners Association
* All homeowners at Avian Glen will automatically become
members of the Homeowners Association
* All building plans must be reviewed and approved by the
Avian Glen Architectural Review Committee.
* Minimum residential unit size is 2200 square feet of total
floor area (excluding garages ) for two-story homes and
1900 square feet of floor area for one-story homes
* Unless otherwise shown on the plat or stated in the cove-
nants, minimum building setbacks are 40 feet for the
front; 20 feet for the rear; and 15 feet at the sides
* All homes must have a minimum two-car garage
