HAZARDOUS WASTE COLLECTION CENTER IN HAMILTON COUNTY,
INDIANA, FOR CALENDAR YEARS 2002 AND 2003
WITNESS THAT:
WHEREAS, the Hamilton County Solid Waste Board, ("the Solid Waste Board") exists
pursuant to Indiana Code 36-9-30; and,
WHEREAS, the Board of Commissioners of Hamilton County ("the Commissioners"),
has provided a building and the Hamilton County Council ("the Council") has provided fundnig
for the improvements to a building owned by the County at 1717 E. Pleasant Street, Noblesville,
Indiana, to be used as a household hazardous waste collection site ("the Site"); and,
WHEREAS, the Hamilton County Health Department ("the Health Department") has
been established pursuant to Indiana Code 16-20-2 and the Administrator of the Health
Department assisted the Solid Waste Board in designing and constructing the Site, as well as
filing applications for grants to operate the Site; and,
WHEREAS, the Indiana Department of Environmental Management has provided grants
to partially fund the operation of the Site.
IT IS THEREBY AGREED by, between, and among the parties as follows:
1. The purpose of this Agreement, is be to prescribe the rights, responsibilities,
and duties of the parties for the operation of the Hamilton County Household Hazardous Waste
Collection Site at 1717 E. Pleasant Street, Noblesville, Indiana, for the balance of the year 2002
and for the year 2003.
2. The Administrator of the Hamilton County Health Department, ("the
Administrator") shall be responsible for hiring and supervising the employees of the Site, as well
as the day to day operation of the Site.
3. The Council agrees to appropriate funds into the household hazardous waste fund
to fund the purposed operation budget for the Site as shown in Exhibit A. The amount of the
appropriation shall include any grants received for the operation of the Site. The amount of the
appropriation from the general fund shall be equal to ~the budget shown 9n Exhibit A, less any
grants which are properly used for operation of the site.
4. The parties agree that the Council shall budget an reasonable amount of funds for
the operation of the Site in calender year 2003 not to exceed the amount shown on Exhibit A.
Said budget shall be approved as part of the annual budget process of the Council.
5. The Site shall only be used to accept household hazardous waste, as defined by
the Administrator. The Site shall only be available to residents of Hamilton County. No waste
from commercial or industrial uses shall be permitted to be deposited at the Site. Employees of
the Site and the Administrator shall be permitted to refuse to accept any large quantities of waste
which they, in their absolute discretion, believe may have originated from commercial or
industrial uses, including small businesses.
6. Any full or part-time employee at the Site, shall be deemed County employee, and
their forms 144 shall be approved as part of the appropriation and budget process by the Council.
7. The parties agree to diligently proceed to open the Site to the public as
expeditiously as possible.
8. The parties agree to review the operation of the Site during May of 2003. At
that time, the parties agree to establish a budget for subsequent operation and administration of
the Site. At that time, the Solid Waste Board will seek a levy beginning in 2004 to provide
funds for the operation of the Site and to equitably reimburse any municipality which has
established a full time operational household hazardous waste facility.
9. The Council agrees to provide a loan to the Solid Waste Board in 2004 and
thereafter, in order to enable the Site to be operated without obtaining semi-annual tax
anticipation loans or warrants.
10. The Commissioners shall cause the Hamilton County Maintenance Department
to be responsible for the maintenance of the Site, as specified in the Grant Application heretofore
approved by the Indiana Department of Environmental Management.
11. The overall operation of the Site, shall be under the jurisdiction of the Solid Waste
Board, subject to any additional costs of operation being appropriated by the Council.
12. The Solid Waste Board shall become solely responsible for the operation and
management of the Site beginning January 1, 2004, and any duties of the Health Department
shall terminate on the date, unless otherwise agreed.
IN WITNESS WHEREOF, the parties have approved this Agreement at their meetings
on the dates set out herein.

dispose of, the facility requires that you provide the following information. Please
fill out the required information so we can better serve you and protect our
employees and facilities in a safe manner.
We can only accept materials from Hamilton County homes and farms. The
material listed on this form represents an accurate accounting of the household
hazardous waste delivered to the Hamilton County Household Hazardous Waste
facility and does not include any of the excluded items listed.
Excluded items include: ammunition, explosives, radioactive material, or
biological wastes.
