D-2599-21 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING THE 2021 SALARY ORDINANCE Synopsis: Amends the 2021 salary ordinance to allow City employees to receive premium pay as authorized by the American Rescue Plan Act and the Common Council. WHEREAS, on October 19, 2020, the Carmel Common Council (the “Council”) adopted Ordinance D-2544-20, as amended, setting 2021 salaries for appointed officers and employees of the City of Carmel (the “City”); and WHEREAS, the City has received grant funds from the American Rescue Plan Act of 2021, a portion of which will be used to compensate City employees with premium pay for essential work performed during the COVID-19 public health emergency (“Premium Pay”); and WHEREAS, in order to comply with Indiana Code, the 2021 salary ordinance must be amended to include the additional compensation received by City employees in the form of Premium Pay. NOW, THEREFORE, IT IS AGREED AND ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Section 15 of Ordinance D-2544-20, as amended, is hereby further amended to add subsection (l), which shall read as follows: “(l) American Rescue Plan Act Premium Pay compensation for City employees Pursuant to the conditions set forth by the Common Council, eligible City employees shall be compensated for essential work hours performed during the COVID- 19 public health emergency at a rate of $2.00 per hour (“Premium Pay”). The total amount of Premium Pay paid to each employee shall not exceed two percent (2%) of their annual base pay.” Section 3. The remaining provisions of Ordinance D-2544-20, as amended, shall remain in full force and effect and are not affected by this Ordinance. Section 4. All prior City ordinances or parts thereof that are inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. Section 5. If any portion of this Ordinance is for any reason declared unconstitutional, invalid or unenforceable by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.
