Additionally, surrounding neighbors have existing in -ground pools with one of the neighbors simultaneously appealing BZA for an in -ground pool as well. The variance request for the Reed pool affects the owner's property only. The pool plans will not encroach or infringe on any adjacent areas. Homeowner Association approval has been previously granted. The pool will be used exclusively by family and friends. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The propertyWill be used by family and friendsand not for general Public use. The Petitioner's Dian forphase II will be to erect wrought iron fence(pending possible varaiance in the backyard of the propertythat encompasses the entire pool. The planned fence will match and connectto the adiacent neighbors on both sides of the Property. The general Dool specs are 3 to 6 feet deep with steps at the lowerend for our children with no diving boards. The pool contractor is well-known in the Indiana communit and has an A+ ratin for pool installations. Final) the pool will have an auto coverfor added security 2. The use and value of the area adjacentto the property included in the variance will not be affected in a substantially adverse manner because: The current community does not have a neighborhood pool therefore many homeowners(including adjacent neighbors) have installed private pools. The proposed Pool is Positioned exclusively on the homeowner's DrOperty and does not encroach on any neighboring ro ert or easements. The Pool project has been viewed and approved by the Homeowner's Association and meets all requirements 3. The strict application of the terms ofthe Unified Developmentto the propertywill result in practical difficulties in the use of the property because: The current 35% max coverage covenant limits the ability to safely and aesthetically integrate the pool and associated elements onto the property.
