HomeMy WebLinkAbout1984 Supplemental AgreementSUPPLEMENTAL ZONING AGREEMENT · THIS SUPPLEMENTAL AGREEMENT made and entered into by and between the City of Carmel,· Indiaha, hereinafter referred to' as "City'!, and Clay Township of Hamilton County, Indiana, hereinafter referred to as "Township", WITNESSETH: WHEREAS, the parties hereto entered into a Zoning Agreement a's of the ls~ day of January, 1983; and WH~REAS,...Pa~agraph 4 thereof readS as follows: 4. At the end of the year 1983, the total of all e~penditures made in the year 1983 for zoning ·expense shall be computed and from that amount all income received, by the City in connection with the operation of the zoning laws of the 'City shall be deducted and the net cost to the taxpayers shall thereby be computed. If the amount of the:.cost of th~ taxpayers for the year 1983 is less than Ninety-Five Thousand Eight Hundred Sixty-One Dollars ·($95,861.00), then and in that event, the money budgeted and unspent shall be 'applied against the budget for 1984, and the pro-rata share of the ~Town'ship of. the budget for 1984' shall be~reduced accordingly; and ' ~WHEREAS, the parties hereto entered Agreement a:s of the .1st day'~f January, · WHEREAS, paragraph 1 of said into a subseque'nt Zoning ~984; and subsequent agreement reads as follows: 1. The Township agrees to pay the sum Of Twenty-Nine Thousand· Dollars ($29,000.00) unto the City on or before July 14, 1984, and the additional sum of Twenty-Eight Thousand Seven Hundred Sixty-Three Dollars ($28,763.00), to the City on or before December 31, 1984; and to WHEREAS, it has been 'determined that the Township is entitled a credit of Fifty-Fou'r Thousand Eight Hundred Six Dollars and SupplemenCl ~ing Agreement ~Page Two Six Cents ($54,806.06) for its share of the income received by the City in the year 1983 ih connection with its operation of the zoning laws; and WHEREAS, it 'has been determined that the unpaid balance of the amount due from the Township to the City for its share of zoning expenses under the '984 contract is Two Thousand Nine Hundred Fifty-Six Dollars and Ninety-Four Cents ($2,956.94); and WHEREAS, it has been determined that a pickup truck should be procured for the use of the personnel in the Building Commis- s'ioner's office in the City; NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the City and Township that the Zoning Agreement entered into as of the day of January, 1983, should be modified and amended as follows: 1. The total cash payment due from the Township to the City shall be reduced to the sum of 'l~wo Thousand Nine Hundred Fifty-Six Dollars~ ahd Ninety-Four Cents ($2,956.94), ~hich shall be due and - payable on or before December 31, 1984. 2~ S'ubjec~ to'.the approval of the State Board of Tax Commissioners, the Township agrees to appropriate Nine Thousand Dollars ($9,000.00) to be used for the purchase and acquisition of a pickup truck to be furnished to the office of the Building Comm i s s ion er. 3. A copy of the liability insurance policy on the truck to be procured by the City shall be f. urnished to the Township.
