THIS AGREEMENT, made and entered into by and between the Town of
Carmel, Indiana, hereinafter referred to as "Town" and Clay Township of
Hamilton County, Indiana, hereinafter referred to as "Township'',
WITNESSETH:
WHEREAS, the Town and Township on the 2nd day of 1VIay, 1961, entered
into an agreement by the terms of which the Township was joined to the Town
of Carmel for the purpose of zoning; and
WHEREAS, it is agreed that the Town and Township would re~iew the
anticipated expenses-and income to be derived from the operation of the Zonin~
Law of the Town 'of Carmel each year, in sufficient time for the Township to
include within its budget a proportionate part of the anticipated zoning expense
For the combined area of said Town and Township; and
WHEREAS, pursuant to said agreement the Township did include within
[ts budget for the year 1971 the sum of Ten Thousand Dollars ($10,000.00) for
regular zoning purposes,
NOW, THEREFORE, it is mutually agreed by and between the Town and
ownship that:
1. The Township agrees to pay the sum of Five Thousand
Dollars ($5,000.00) unto the Town on or before July 15, 1971, and
the additional sum of Five Thousand Dollars ($5, 000.00) to the
Town on or before December 31, 1971.
2. The Town agrees to accept Ten Thousand Dollars
~$10, 000.00) and to use and apply the same on the cost of operation
of planning and zoning ordinances for the combined territory of the
Town and Township, said total sum of Ten Thousand Dollars
($10,000.00) to be supplemental to all funds received and collected
by the Town by way of fees for building permits, etc.
2. It is further agreed that the Town and Township will re-
view the income and expenses incurred in the operation of the zoning
'ordinances for said Town and Township since the effective date of.the
joinder agreement and up to the first day of July, 1971, and that
from said review the Town and Township will negotiate to determine
the share of the zoning expenses anticipated in the year 1972 which
should be raise8 by a levy upon the Township by way of taxes for 1971
payable in the year 1972.
IN WITNESS W~IEREOF, the Town and the Townshil~ by and through their
duly elected, qualified and acting officials, have hereunto caused their names
to be affixed and their seals to be affixed this / day of January, 1971.
