AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA AMENDING CHAPTER 2, ARTICLE 3, DIVISION II, SECTION 2-81
OF THE CARMEL CITY CODE
WHEREAS, the demand for field inspection services provided by the Department
of Community Services has grown substantially in the past few years; and
WHEREAS, there is an additional need for the City to initiate administrative
enforcement actions to ensure compliance with the Carreel/Clay Zoning Ordinance; and
WHEREAS, the responsibilities of the department's Building Inspectors do not
allow them sufficient time to also enforce various land-use regulations in the City of
Carmel and Clay Township; and
WHEREAS, the Carmel Common Council, the Mayor and the community expect
that ordinances passed by the Council will be enforced; and
WHEREAS, to ensure efficient around-the-clock operations, the Water
Department will be assigning one or more employees to the second shift; and
WHEREAS, all other City of Cannel employees whose shifts begin between 2:00
p.m. and 11:00 p.m. are receiving a shift differential; and.
WHEREAS, it is fair and proper for the water deparlxnent employee(s) referenced
above to receive the shift differential paid to other City employees who work the second
shift.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Cannel, Indiana, as follows:
1. Chapter 2, Article 3, Division II, Section 2-81 of Cannel City Code is hereby
amended to include the following:
a. DEPARTMENT OF COMMUNITY SERVICES
Up to A Maximum
Bi-Weekly Salary of
"Code Enforcement Inspector
1502.42"
b. Section l7. "Water and Wastewater Treatment Plant employees whose
regularly assigned shift begins between the hours of 2:00 p.m. and 11:00 p.m.
shall be entitled to receive shift differential pay of $.50 per hour for each hour
worked, in addition to all other forms of compensation."
2. This Ordinance shall take full force and effect upon passage and such publication as
may be required by law.
3. All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed as of the effective date of this Ordinance.
4. This amendment does not change or affect any other provisions contained in City
Code Section 2-81, which provisions remain in full force and effect.

Ordinance D-1470-00 amends the 2000 salary ordinance in two ways.
The position of Code Enforcement Inspector is added in the Department of Community Services,
as discussed at the department's budget workshop. This amendment will allow for the inspector
position to be filled this year rather than waiting until next year. Please speak with Steve Engelking
if you have questions or comments about that position.
The Code Enforcement Inspector is already listed in the 2001 salary ordinance, so it will not be
necessary to amend that document for the inspector position.
The language for shift differential pay in the Utilities Department is expanded to include water
employees as well as wastewater employees. John Duffy only recently made the decision to
assign one of his Water Plant Operators to a second shift during the buslet summer months. This
employee should be eligible for shift differential pay, as are all other second shift employees in the
PLEASE NOTE: The shift decision was made too late to get it into the 2001 salary ordinance, so
in the interest of consistency that ordinance should also be amended to make employees in the
water department eligible for shift differential.
The easiest way to amend the 2001 salary ordinance to achieve the desired result is to add the
words "Water and" to the beginning of Section 15.
