AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING CHAPTER 9, ARTICLE 2, DIVISION IV, SECTION 9-59(a) AND
CHAPTER 9, ARTICLE 3, DIVISION V, SECTION 9-174(b) OF THE CARMEL CITY CODE
WHEREAS, the Common Council of the City of Carmel, Indiana, has the authority to amend the
Carmel City Code; and
WHEREAS, City Code Chapter 9, Article 2, Division IV, Section 9-59, sets forth the payment
terms for water and/or sewer service provided to its customers by the Carreel Utilities Department; and
WHEREAS, City Code Chapter 9, Article 3, Division V, Section 9-174, provides the procedure
regarding delinquent accounts for service provided to its customers by the Carreel Utilities Department;
and
WHEREAS, the Common Council desires to amend the payment period for services provided to
its customers by the Carreel Utilities Department.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carreel,
Indiana, as follows:
1. The foregoing recitals are fully incorporated herein and made a part hereof.
2. Chapter 9, Article 2, Division IV, Section 9-59(a) of the Carmel City Code is hereby amended
to read as follows:
"(a) All payments for water and/or sewer service must be received in the office of the
Carmel Utilities Department within eighteen (18) days from the billing date stated on the
bill. Customers who are habitually late with their payments, more than three (3) times in
any calendar year, may be required to make a One Hundred Dollar ($100.00) deposit, to
be applied for all or part payment of a bill not paid by said customer, or have their water
and/or sewer service discontinued. If the total amount of the deposit is not used, the
remainder of the deposit will be refunded to the customer after their service has been
discontinued."
The remaining portions of City Code Chapter 9, Article 2, Division IV, Section 9-59 are not affected by
this Ordinance and shall remain in full force and effect.

3. Chapter 9, Article 3, Division V, Section 9-174(b) of the Carreel City Code is hereby amended
to read as follows:
"Sec. 9-174(b) All payments for sewer service must be received in the Office of the
Carmel Utilities Department within eighteen (18) days from the billing date stated on the
bill, Failure of a user to make timely payment shah subject the user to a late charge of
ten percent (10%)."
The remaining portions of City Code Chapter 9, Article 3, Division V, Section 9-174 are not affected by
this Ordinance and shall remain in full force and effect.
4. All prior ordinances or pans thereof inconsistent with any provision of this Ordinance are
hereby repealed as of the effective date of this Ordinance.
5. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid,
such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
6. This Ordinance shall be in full force and effect from and after its passage, signing by the Mayor
and such publication as is required by law.
