D-1454-00 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 5, SECTION 8-47 OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel has the authority to amend the Cannel City Code and to establish City traffic and parking regulations; and, WHEREAS, the Common Council desires to amend Chapter 8, Article 5, Section 8-47 of the Cannel City Code; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Cannel, Indiana, as follows: follows: Chapter 8, Article 5, Section 8-47 of the Carmel City Code is hereby amended to read as "Sec. 8-47. Three-Hour Parking Limit in City Parking Lots. (a) Three-hour parking zones are created and established in the following City parking lots: (i) The City owned or controlled parking lot located on the noah side of Main Street in the first block west of Range Line Road. This lot is generally bounded on the south side by Main Street, on the west side by the building located at 38 West Main Street, on the noah side by the east-west alley between Main Street and 1st Street 'N.W., and on the east side by the building located at 26 West Main Street. Three- hour parking shall apply to this entire parking lot between the hours of 8:00 A.M. EST and 6:00 P.M. EST daily. (ii) The City owned or controlled parking lot located on the south side of Main Street in the second block east of Noah Range Line Road, behind the Carmel Lion's Club building having a common address of 141 East Main Street, Cannel, Indiana. This lot is generally bounded on the noah side by said Cannel Lion's Club building, on the east side by buildings contained within Park Lane Apartments located on Bryn Mawr Lane, and on the south side by the building located at 170 Cannel View Drive and on the west side by the buildings located at 121 1st Street S.E. and 131 1s' Avenue S.E. Three hour parking shall apply to this parking lot between the hours of 6:00 A.M. EST and 9:00 P.M. EST daily. (iii) Reserved. Page One of Three Pages [cb:msv, ord:z: law',c bass',my documents\ordinances\an~endcodc\parking.doc:2/28/O0] (b) The provisions of paragraph (a) above shall not apply to vehicles which properly display a valid merchant vehicle sticker. Merchant vehicle stickers shall be issued gratis by the Carmel Police Department for any vehicle registered to any person who is employed by a merchant located within the corporate limits of the City of Carmel, Indiana. A valid merchant vehicle sticker shall authorize said person to park his or her vehicle in a City parking lot while he or she is at work within the City's corporate limits and for one-half hour before and after each such work shift. A separate merchant sticker shall be issued for each eligible vehicle. Merchant vehicle stickers are not transferable between vehicles. (c) Any person who loses, misplaces or has his or her merchant vehicle sticker stolen shall report this fact to the Carmel Police Department within forty-eight (48) hours of the loss. (d) Any use of a merchant vehicle sticker in violation of this Section shall void the sticker and make the person to whom the sticker was issued ineligible to obtain another merchant vehicle sticker for a period of one ( 1 ) year from the date of such violation. (e) Any vehicle displaying a merchant vehicle sticker that was not issued to that vehicle may be towed and a fine assessed against the owner of said vehicle pursuant to paragraph (f) of this Section. (f) Notwithstanding Section 8-92 of this Chapter, the penalty for each violation of this Section shall be not less than Ten Dollars ($10.00) nor more than Five Hundred Dollars ($500.00). Each day shall constitute a separate violation. In addition to the fine assessed pursuant to this paragraph, and notwithstanding Section 8-92 of this Chapter, any vehicle violating this Section may be towed and impounded at the owner's expense. The costs of such tow-in and impoundment shall be paid by the vehicle owner, or the owner' s designee, prior to the release of the vehicle. (g) The Carmel Street Department shall cause to be posted appropriate signage, setting forth the above parking limitations and indicating that the parking lot is a "Tow Away" area, promptly upon passage of this Ordinance." 2. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. 3. This Ordinance shall be in full force and effect from and after the date of its passage, signing by the Mayor and such publication as is required by law.
