D-1451-00 AMENDED AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AMENDING CHAPTER 3, ARTICLE 1, DIVISION II, SECTIONS 3-12, 3-13 AND 3-14 OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel has the authority to amend the Carmel City Code; and, WHEREAS, the Common Council desires to amend Chapter 3, Article 1, Division II, Sections 3-12, 3-13, and 3-14 of the Carreel City Code; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section I: Section 3-12 of the Cannel City Code hereby is amended by the deletion of the language which is stricken-through and by the addition of the language which is highlighted, to read as follows: Sec. 3-12 Presiding Officer. The presiding officer of the Common Council shall be the Mayor of the City. The Mayor will: (a) Call and. adjo'un~ 'meetin.~s of the Con~mon Co'uncil. Conduct meetings according to thc mlcs of the Common Council and in absence of appropriate Council mlcs, will adherc to Roberts Rulcs of Order; ho~vover, Council roles shall supersedc Robcrts Rulcs of Order if inconsistencies occur; (b) Usc personal discretion in the cnforcement of such roles, especially with rcgard to Council discussions; (c) Not take part in debate on any motion, Resolution and/or Ordinance being considered by the Council without first relinquishing the chair to the President Pro Tempera for the duration of debate and/or discussion of said motion, Resolution and/or Ordinance; except the Mayor may respond to questions from Council members on said items without relinquishing the chair; and (4)(b) Not vote on any motion, Resolution and/or Ordinance being considered by the Council unless after any such vote, the Council shall be equally divided on the issue (with at least three (3) votes in the affirmative), whereupon the Mayor may choose to vote in the affirmative if he/she so chooses. Section II: Section 3-13 of the Carmel City Code hereby is amended by the deletion of the language which is stricken-through and by the addition of the language which is highlighted, to read as follows: Sec. 3-13 President Pro Tempore. The Common Council shall elect at its first regular meeting each year from its membership a President Pro Tempore for a term of one ( 1 ) year. The President Pro Tempore shall not be eligible to succeed himself/herself for the following year. The President Pro Tempore shall: (a) Conduct meeti:n~s accordin~ to the rul. es of the Com.n~on Council. and in absence of appropriate Council rules, will adhere t'o Roberrs Ru. les of Order; h.owever, ..C.~0uncil rules shall supersede Roberts Rules of Order if inconsistencies occurl (b) U'se persona! discretion in the enibrcement of such rules, especially with regard to Council .discussions; (-a-)~.) Serve as presiding officcr chair of the Common Council, in the absencc of thc Mayor or if thc Mayor rclinquishes the gavel, but after assuming the chair, will not relinquish his/her voting rights on any motion, Resolution and/or Ordinance being considered by the Common Council; (-b)(d) Not take part in discussion or debate on any motion, Resolution and/or Ordinance without relinquishing the chair to the Clerk Treasurer of the Gi~ Vice President Pr_o .,;'erapore for the duration of discussion and/or debate on said motion, Resolutiun and/or Ordinance. If the Clerk Treasurer Vice President Pro 'I'empore is not present, the President Pro Tempore may designate amy Council mcmber the Clc~k-Treasurer as prcsiding officer chair for the duration of debate on the question beibre the Council; and (e) In the absence of the Mayor, serve as, call and adjoum meetings of the Corn.men Council. Section III: Section 3-14 of the Carmel City Code hereby is amended by the deletion of the language which is stricken--through and by the addition of the language which is highlighted, to read as follows: Sec. 3-14 Appointments by Prcsiding OfficcrPresident Pro Temoore. The Mayor President Pro Tern.pore shall appoint at the beginning of each year the following positions: (a) Vice President Pro Tendpore. Chaplain. Parliamentarian. Section IV: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section V: This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
