AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
ADOPTING TRAFFIC REGULATIONS FOR CARMEL CLAY SCHOOLS PROPERTY
WHEREAS, the Common Council of the City of Carmel, Indiana, has the authority to adopt traffic
regulations governing traffic control on public school grounds when requested by the governing body of a
school corporation, pursuant to Indiana Code § 9-2 1-1-3(a)13; and
WHEREAS, the Carmel Clay Board of Education, the governing body of the Carmel Clay Schools,
has, by resolution, a copy of which is attached hereto and incorporated herein as Exhibit A, requested the
City to adopt traffic regulations governing traffic control on Carmel Clay school grounds; and
WHEREAS, improper vehicular driving and parking on school property can endanger public health
and safety; and
WHEREAS, the adoption of traffic regulations governing traffic control on Carmel Clay school
grounds is in the best interests of the City, its school children, and the public at large.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana,
as follows:
1. The foregoing recitals are fully incorporated herein and made a part hereof.
2. Section 8-10 is hereby adopted and added to the Carmel City Code and shall read as follows:
"Authority and Duties of Police on Carmel Clay School Property
(a) Carmel City Code Sections 6-49, 6-114 through 6-122, 8-1, 8-2, 8-
18, 8-30, 8-31, 8-34, 8-35, and 8-90 through 8-93, inclusive, are hereby
adopted as traffic regulations governing traffic control on all Carmel Clay
Schools grounds and/or property located within the corporate limits of the
City of Carmel, Indiana.
(b) In addition to its other activities, the Carmel Metropolitan Police
Department, and any Special Police officers appointed, sworn and
assigned to serve the Carmel Clay Schools by the City of Carmel Board of
Public Works and Safety pursuant to Indiana Code Section 36-8-3-7, shall
have the authority and duty to enforce the traffic ordinances and laws
referenced in subparagraph (a) above, and to take such other actions as
are set forth in City Code Section 8-9, as regards any violations of said
ordinances and laws that take place on any Carmel Clay Schools grounds
located within the City's corporate limits."

3. Section 8-18(a) of the Carmel City Code is hereby amended to read as follows:
Delete: "(a) No person shall drive a motor vehicle in excess of 15 miles per hour
on the following streets:
(1) Emerson Road from 4th Avenue Southwest to Sherman Drive.
(2) Reserved.
Add:
"(a) No person shall drive a motor vehicle in excess of 15 miles per hour on the
following:
(1) Emerson Road from 4th Avenue Southwest to Sherman Drive.
(2) All Carmel Clay Schools grounds located within the City's corporate
limits.
(3) Reserved."
The remainder of Section 8-18 of the Carmel City Code shall be unaffected by the above amendments and
shall remain in full force and effect.
4. Schedule A to Section 8-30(c) of the Cannel City Code, which is codified as City Code Section 8-
120, is hereby amended to include the following:

The remainder of Sections 8-30 and 8-120 of the Carmel City Code shall be unaffected by the above
amendments and shall remain in full force and effect.
5. Section 8-29 of the Carmel City Code shall be amended to include Section (c) thereof, which
shall read as follows:
Driving in the wrong direction from that posted on any Carmel Clay
Schools property is prohibited,"
The remainder of Section 8-29 of the Carmel City Code shall be unaffected by the above amendments and
shall remain in full force and effect.
6. Section 8-51 of the Carmel City Code shall be amended to include Section (d) thereof, which
shall read as follows:

No vehicle shall be parked on any Carmel Clay Schools property posted
with "No Parking" or other appropriate signage, Any vehicle violating this
paragraph (d) may be towed at the owner's expense.and a ticket issued
and the fine assessed pursuant to Section 8-92 of this Code, The Carmel
Street Department shall cause appropriate signage to be posted
immediately upon passage of this subsection,"
7. Nothing in this Ordinance shall be construed as limiting or otherwise affecting any other
rights, duties, privileges or responsibilities of Carmel Metropolitan Police Department officers, Special
Police officers, or others as may be provided by law or in equity.
8. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid,
such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement
of same can be given the same effect.
9. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are
hereby repealed.
10. This Ordinance shall be in full force and effect from and after the latter of (i) its passage,
signing by the Mayor and such publication as is required by law, or (ii) the date on which signs giving notice
of the traffic regulations referenced herein are posted upon or at the entrance to the streets and/or property
affected thereby.
