HomeMy WebLinkAboutD-1414-99 1st Quarter ALP CodificationORDINANCE D- 1414-99 AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE CITY OF CARMEL, INDIANA WHEREAS, American Legal Publishing Corporation of Cincinnati, Ohio, has completed the First Quarter 1999 Supplement to the code of ordinances of the City of Carmel, which supplement contains all ordinances of a general nature enacted since the prior supplement to the code of ordinances of this municipality; and, WHEREAS, American Legal Publishing Corporation has recommended the revision or addition of certain sections of the Code of Ordinances which are based on or make references to sections of the Indiana Code; and WHEREAS, it is the intent of the Council to accept these updated sections in accordance with the changes of the law of the State of Indiana. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana: 1. James Brainard /s/ James Brainard, Mayor ATTEST: Diana L Cordray/s/ Diana L Cordray, IAMC, Clerk-Treasurer XXiV (April 1999 Supplement) § 2-81 CIT r ADMINISTRATION § 2-81 1) For all civilians and for Firelighters in administrative positions, the scheduled hours shall be 37.5 in a seven (7) day work period (75 bi- weekly). 2) For Police Department Investigators and Officers in administrative positions, the scheduled hours shall be 160 in a 28 day work period (80 bi-wcckly). 3) For Police Department Road Patrol, the scheduled hours shah be 136 in a 24 day work period (79 bi-weekly). 4) For Firetighters who work a 24 hour shift, the scheduled hours shall be an average of 224 hours in a 28 day work period (112 bi-weekly). d) The formula for calculating the overtime rate of pay shah be: 1) For Fire Department non-exempt shift employees, 0.5 x hourly rate of pay (as determined by formula in 5b above) for scheduled overtime from 212- 224 hours, and 1.5 x hourly rate for scheduled overtime in excess of 224 hours and for all emergency call-outs, end-of-shift runs and work-related court appearances. 2) For all other non-exempt City employees, 1.5 x hourly rate of pay (as determined by formula in 5b above). (6) All base salaries shall be within the guidelines established by the grade and step plan developed in 1998 to be effective in 1999 and thereafter. (7) Compensation for Meetings a) Appointed members of the Plan Commission, Board of Zoning Appeals, and Cable TV Advisory Committee shall be paid the sum of $50.00 per regular scheduled meeting. Appointed members of the Plan Commission shall receive an additional $50.00 per standing sub-committee meeting. b) Full-time employees of the Department of Community Services shall be, at the request of the Department Director, entitled to receive the sum of $50.00 per meeting as additional compensation for attending each regular or special meeting of the Plan Commission or Board of Zoning Appeals, or their respective committees or task forces, if such meetings are held outside the regular working hours of 8:00 a.m. and 5:00 p.m. Such additional compensation shall be paid from the budgets of the Plan Commission and Board of Zoning Appeals. c) Appointed members of the Board of Public Works and Safety shall be paid a salary of $3,167.25 per year. (1) Every vendor, including their agents, servants, or employees, desiring to engage in a door-to-door activity within the limits of the City of Cannel, Indiana, shall first obtain from the office of the Clerk-Treasurer a license permitting such door-to-door sales. (Ord. No. D- 1034, 12-6-93) (2) The Clerk-Treasurer shall provide each applicant with a form questionnaire application to be processed by the Clerk-Treasurer's office. The application shall contain questions regarding the applicant's principal place of business, nature of sales and product, background and history, and such other information as the Clerk-Treasurer deems relevant. The application shall also require the applicant to obtain and attach thereto a copy of the applicant's limited criminal history, which the applicant shall obtain from the Indiana State Police Department. The Clerk-Treasurer shall submit each completed application to the Carreel Police Department for review. (Ord. No. D-1409-99, 3-15-99) (3) A license shall be issued by the Clerk-Treasurer upon the applicant satisfactorily completing the application, confirmation by the Carreel Police Department that the applicant has no felony or misdemeanor convictions which would constitute crimes of moral turpitude, and receipt from the applicant of the appropriate license fee. (Ord. No. D-1034, 12-6-93; Ord. No. D-1409-99, 3-15-99) (4) Each vendor shall openly display upon his person while engaging in door-to-door sales activity an I.D. card issued by the Clerk-Treasurer. It shall be illegal to transfer the license to any other person not listed on the application. (Ord. No. D-480, § 2.01, 5-5-86; Ord. No. D-1034, 12-6-93) (5) Each Exempt Person (other than Carmel/Clay resident minors) desiring to engage in door-to-door activity shall first deliver to the office of the Clerk-Treasurer the following information: Principal place of business address; description of the nature of the business; proof of exempt status reasonably satisfactory to the Clerk-Treasurer; copies of all written information which is intended for distribution to the public; the anticipated time frame (days, weeks, etc.) and duration of the door-to-door activity; and a list of names of all persons who will be representing the Exempt Person. The Exempt Person shall cause those persons representing it to display in conspicuous view while engaging in the door-to-door activity, an LD. card, issued by the Clerk-Treasurer, identifying the name of the Exempt Person. The Clerk-Treasurer shall issue the I.D. cards within five (5) business days of receipt of the required information. (Ord. No. D-1206, 5-6-96) (c) RBSTRIClIONS ON LICENSE. (1) Each licensee and Exempt Person shall be restricted to conducting door-to-door activities between the daytime hours of 9:00 a.m. and 9:00 p.m. during any weekday or weekend day. (Ord. No. D-1206, 5-6-96) (2) Each license shall be valid for a specified period of time. Upon the expiration of the license, the vendor shall either reapply to the Clerk-Treasurer or cease its activity. 121 (April 1999 Supplement) (3) Each vendor shall comply with all Ordinances of the City of Carmel, Indiana, Hamilton County, and statutes of the State of Indiana relating to the license or its use, and failure of a license holder to do so may result in revocation of the license. No. D-1034, 12-6-93) (4) Exempt Persons shall comply with all Ordinances of the City of Carreel, Hamilton County, Indiana, and statutes of the State of Indiana as it conducts door-to-door activity. (Oral. No. D-1206, 5-6-96) (d) RBVOCATION OR RBFUSAL TO LICBNSB. (1) If the Clerk-Treasurer determines the applicant for a door-to-door license has caused any of the following, then the Clerk-Treasurer shall notify the Executive, or his/her designee, who shall refuse to issue license or shall revoke an issued license: (i) Put false information on the application; (ii) Been convicted of a felony or serious misdemeanor amounting to moral turpitude; (iii) Violated an Ordinance of the City of Carreel, State of Indiana, or Hamilton County relating to the license or its use; (iv) Violated the restrictions of the license; (v) Failed to display the permit or license; (vi) Transferred the license to a nonapproved person; (vii) The Clerk-Treasurer receives more than one verifiable complaint of rudeness, forcible tactics, refusal to leave, or other undesirable behavior from a resident of the City of Carreel concerning the applicant's use of the license. (2) Notice of revocation shall be made in writing by the Mayor and may be served either by mail or by personally serving the licensee with the written notice of revocation. (3) Denial or revocation of a license by the Clerk-Treasurer or the Executive of the City, or his/her designee, shall entitle the applicant, upon written request within seven (7) days of the issuance of the denial, to appeal the decision to the next regularly scheduled meeting of the Carreel Board of Public Works and Safety. No. D-1034, 12-6-93) (4) If the Clerk-Treasurer determines that the Exempt Person has caused any of the following, then the Clerk-Treasurer shall notify the Executive or his/her desiguee, who shall cause the Exempt Person to either cease the door-to-door activity or to apply for a license as a vendor: (i) Delivered false or incomplete information as required in subsection (b)(5) above; and/or (ii) Violated subsection (b)(5) or (c)(4) of this Section or violated any other Ordinance of the City of Carreel. All decisions made by the Executive or his/her designee shall be made in writing and delivered to the Exempt Person at the address provided to the Clerk-Treasurer pursuant to subsection (b)(5). Any decision by the Clerk-Treasurer that an applicant is not an Exempt Person as defined hereunder, any decision to require cessation of door-to-door activity or to require application for a license may be appealed to the Board of Public Works and 122 (April 1999 Supplement) § 4-30 FEES, LICENSES, PERM1TS, AND FRANCHISES § 4-40 The consent of the City of Camel is given and granted unto the proper legal authorities of the State of Indiana, to issue liquor retailer's permits for the sale of alcoholic, spirituous beverages to applicant8 otherwise duly qualified to premises within the City. (Ord. No. D-30, 9-5-61; Carreel City Code, § 32.03, 1979) Sec~ 4-31 through 4-39 ~set~ f~r ~ U~ (a) TAXW. AB shall mean any motor vehicle: (1) Designed and constructed to accommodate and transport passengers, not more than six (6) in number, not including the driver; and (2) That does not operate over any definite and designated route within the corporate boundaries of the City of Carmel and the suburban territory thereof; and (3) The destination of which is designated by the passenger or passengers at the time of their transport; and ~ I.C., 7.1-3-9-3, authorizes the Common Council to enact an enabling Ordinance consenting to the issuance of liquor retailer's permits. 7 I.C., 8-2.1-17-16, defines "taxicab" as used in the "Motor Carrier Act." 125 (April 1999 Supplement) (4) The services of which are held out to the public, for hire. (b) LIMOUSINES shall mean any motor vehicle: (1) Designed and constructed to accommodate passengers, in the rear seating area of at least four (4) in number but not more than eight (8), not including the driver; and (2) That does not operate over any definite and designated route within the corporate boundaries of the City of Camel and the suburban territory thereof; and (3) The destination of which is designated by the passenger or passengers; and (4) Services of which are held out to the general public for hire. (5) A Limousine may be a "classic, luxury, or vintage car," as those terms are commonly used. (Ord. No. D-512, § I, A, 5-4-87) (a) No person shall operate a taxicab or limousine service, offer to transport, or transport any passenger or person for compensation or as a contractual service, from any location in the City of Camel, Indiana, unless licensed pursuant to this Division. (b) Exceptions: The following vehicles are not considered taxicabs or limousines pursuant to this Division: (1) Motor vehicles designed for transportation of the sick, injured or disabled persons, by vehicles commonly known as ambulances; and (2) A hearse used by funeral directors in that employment; and (3) Motor vehicles owned by private or charitable organizations to transport their members, or the mentally or physically disabled, without compensation for that transportation. No. D-512, § I, B, 5-4-87) S~4-42 Authuritym]mueLf,x~-'~ The Clerk-Treasurer of the City of Camel, is authorized to issue licenses for the public transportation of passengers for hire of motor vehicles, as defined herein. These licenses shall be taxicab, Limousines, and driver's licenses. (Ord. No. D-512, § II, A, 5-18-87) (a) A written application for a license authorized by this Division shall be made and signed by the owner, general parmer(s), or corporate president as the case may be, of the business to be licensed. 126 (January 1994 Supplement) § 443 FEES, LICENSES, PERMITS, AND FRANCt-HSES § 445 (b) In addition to any other requirements imposed by this Division, all applications shall be on a form provided by the Clerk-Treasurer and contain the following information: (1) The number of taxicabs or limousines to be operated by the applicant. (2) The manufacturer's vehicle identification number, seating capacity of the vehicle, the year of manufacture of the vehicle, and the current Indiana license plate number for each vehicle to be operated by the applicant. (3) The applicant shall state whether a color scheme or trademark is to be designated on the vehicle and if so of what that consists. (4) Whether or not the vehicle will contain advertising and where. (5) A current financial statement of the applicant. (6) Whether the applicant, his drivers, and in the case of a partnership or corporation, have ever been convicted of any felony, operating a motor vehicle while intoxicated, or reckless driving. (7) Copies of the applicant's, and each of the applicant's drivers, limited criminal history, which shall be obtained by the applicant/driver from the Indiana State Police Department. All applications shall be transmitted by the Clerk-Treasurer to the Carmel Police Department for review. (8) Any other information required by the Clerk-Treasurer, or Carreel Common Council. (Ord. No. 1409-99, 3-15-99) (a) In the case of taxicabs, no license shall be issued to any applicant for a taxicab placed in service after the third model year and shall not be issued to any taxicab in operation by any applicant more than the sixth model year of its construction; and which does not have the following: four (4) doors, a rigid roof, a rear trunk, a rear seat designed to seat three (3) persons comfortably, a taxicab may have attached an advertising frame or construction on the body of the vehicle which would not be a hazard to pedestrians, vehicular traffic, or in any way restrict the vision of the driver of the vehicles. (b) In the case of limousines, no license shall be issued to any applicant for a limousine placed in service after the sixth model year of its construction, other than a vintage, luxury, or a classic car as contemplated under this Division. (Ord. No. D-512, § I, C, 5-4-87) (a) The annual fee for a license required by this Division for each taxicab or limousine, used in the business, shall be One Hundred Dollars ($100.00); the fee for each transfer of a license from one vehicle to another shall be the sum of Fifty Dollars ($50.00); the renewal fee for a license required under this Division for each taxicab or limousine, shall be One Hundred Dollars ($100.00) for all or part of any year. 127 (April 1999 Supplement) § 4-45 FEES, L[ SF , PERM S, AND FRA SF_ § 4-48 (b) The term "annual" for purposes of this Division, shall mean for a period of one calendar year. (Ord. No. D-512, § I, D, 5-4-87; Ord. No. D-1035, 12-6-93) (a) Each licensee shall maintain a manned dispatch office within the City limits of Carreel, in an area properly zoned for such office. (b) Removal of the manned dispatch office from the City limits of Carreel, unless otherwise approved by the Carreel Common Council, shall result in the immediate revocation of all licenses granted to the licensee, and its driven. (Ord. No. D-512, §III, A, B, 5-4-87) (a) No license shall be issued until the applicant has filed with the Clerk-Treasurer an insurance binder demonstrating that the applicant has sufficient insurance for liability and property damage, in those mounts provided in this DMsion. (b) A licensee shall maintain public liability insurance covering each taxicab or limousine to be used by the applicant in his business, in an amount of at least: (1) Taxis only: Five Hundred Thousand Dollars ($500,000.00) single limit liability insurance for personal injury; (2) Limousines only: One Million Dollars ($1,000,000.00) single limit liability insurance for personal injury. (3) For both: One Hundred Thousand Dollars ($100,000.00) single event liability insurance for property damage. (c) The insurance policies required herein must contain an endorsement that cancellation of the policy, by the issuer, may be effecteel only upon thirty (30) days written notice by insurer to the Clerk-Treasurer of the City of Carreel, Indiana, of the insurers intention to terminate the policy. (Oral. No. D-512, § W, A, B, C, 5-4-87) (a) Each license shall be valid for a period of one calendar year. Upon the expiration of the license, the vendor shall either reapply to the Clerk-Treasurer or cease its activity. It shall be the sole respons~ility of the vendor and driver to reapply for a renewal in a timely manner and the Clerk-Treasurer is not required to notify the vendor or driver prior to expiration of his license before revocation or refusal to issue a license takes place. Once the vendor and/or driver comes into compliance with all sections of this Division, and all fines and fees are paid, the license may be reissued by the Clerk-Treasurer. (b) Any vendor making application for renewal may do so by mail; however, it shall not be 128 (January 1994 Supplement) § 4-48 FEES, LI SES, PERMITS, AND FRANCES § 4-50 the respons~ility of the City to ensure that the application for renewal was received and processed. Sole responsibility for that process will reside with the vendor and/or licensee. (Ord. No. D-512, § V, A, B, C, 5-4-87; Ord. No. D-1035, 12-6-93) (a) Upon approval by the Clerk-Treasurer of an applicant's application, renewal application or petition to transfer, a hearing shall be scheduled before the Common Council for final approval of the applicant's license. (b) No hearing shall be scheduled before the Common Council, until the Clerk-Treasurer certifies that all required documents have been filed with that office. (c) After a hearing before the Common Council, it shall make a finding and instruct the Clerk-Treasurer to act in accordance with its finding. If the finding is favorable, an applicant shall be entitled to receive the appropriate license within ten (10) days of the notification by the Clerk-Treasurer. (Ord. No. D-512, § VI, A, B, C, 5-4-87) (a) POSTtoO OF HCENSB. Each licensee shall display at all times in its vehicle, a current license issued by the office of the Clerk-Treasurer authorizing that licensee to operate within the City limits of Carmel, Indiana. (b) RATES AND CHARGES. Each licensee under this Division shall file with the Clerk- Treasurer a copy of that licensee's current fare schedule, which shall be open to the public and ah~it all rates and charges which the licensee has established and requires as payment for any of its services. It shall be unlawful for any licensee to charge or to permit to be charged a fare greater than is specified in its rate schedule. A fare schedule may only be changed upon thirty (30) days written notice to the Clerk-Treasurer. All licensees shall display their rates in a prominent place within each licensed vehicle. (c) COLOR SCHEld~. (1) The Business name and color scheme to be used by each licensee under this Section shall not be similar to one being used by another licensee, nor shall any name or color scheme in any way tend to deceive the public as to the identity of the licensee. For purposes of this Section, the licensee which has been using a particular name or color scheme for the longest continuous period of time shall be entitled to continue to use it, without infringement, The unlawful or improper intrusion by any other licensee upon the business name similarity in business name, or vehicle color, shall subject said licensee to an immediate revocation of his license, after a hearing before the Common Council. (2) Notwithstanding the foregoing, every taxicab licensee shall have the name of the Cab Company, as the name is known in the community and disclosed on its application, printed in easy to read letters on the side of each taxicab. 129 (January 1994 Supplement) § 4-50 FEES, LICENSES, PERMITS, AND FRANCHISES § 4-52 (d) ADVERTISING. Commercial advertising may be permitted on placards located on the rear or top of each licensed taxicab. No placards shall be placed on the taxicab in such manner as to hinder, block, or obscure the vision of the driver of the taxicab or any other vehicle. It is the intention. of this provision to permit a licensee to provide commercial advertising for commercial enterprises regarding subjects not contrary to the peace, dignity or public good. Further, that this advertising provision is not intended to fall within nor be controlled by any relevant provision of the Carreel Sign Ordinance, as to taxicabs only. (Oral. No. D-512, § VI, A, B, C, D, 5-4-87) Sec. 4-~1 Tszicab Stands. Upon written request, by a licensee, the Common Council may, after a hearing before it, designate certain areas within the City of Carreel, as regular parking space for taxicabs, and it may prescn~e rules for the usage of said stands suitable to the applicant's business and in conformance with the public convenience and welfare. (Ord. No. D-512, § VIII, A, 5-4-87) Sec. 4-52 Empbl~cnt of Drivers. (a) No person under the age of eighteen (18) years of age, shall be permitted to operate, by any licensee, any taxicab or limousine on any street of the City of Carmel. (b) All drivers shall be licensed in conformance with this Division and State statute. It shall be a violation for any licensee to permit an unlicensed driver to operate a cab within the Carreel City limits. (c) Each licensee shall submit an application for each driver who will operate a taxicab or limousine within the Carreel City limits, on a written form, provided by the Office of the Clerk- Treasurer. The written information contained in said application shall include the following: (1) Name, address and age, Social Security Number and date of birth of the driver; (2) Whether or not the driver has been convicted of any felony, the offense of operating a motor vehicle while intoxicated, or reckless driving, and/or if the driver's license has ever been revoked, suspended, cancelled or seized by any State agency. (3) Copies of the applicant's, and each of the applicant's drivers', limited criminal history, which the applicant/driver shall obtain from the Indiana State Police Department. (4) Copies of the applicanfs, and each of the applicants' drivers', Indiana driving record abstract, which the applicant/driver shall obtain from the Indiana Bureau of Motor Vehicles. (5) Such other information as the Clerk-Treasurer shall deem necessary. (6) All applications shall be transmitted by the Clerk-Treasurer to the Carreel Police Department for review. 130 (April 1999 Supplement) § 4-52 FEES, HCENSES, PERMITS, AND FRANCHISES § 4-54 (7) That the Clerk-Treasurer shall be entitled to collect a fee of Twenty-Five Dollars ($25.00) for each approved driver's license application submitted. (d) Each driver, licensed by the City of Carreel shall display in his cab, during those hours in which he is operating the cab, his license in a prominent place located on the dash board of the cab. (e) Every licensed driver shall be hygienically, well groomed, and neat in appearance and suitably dressed. Male driven should be clean shaven and hair neatly trimmed. If a beard or mustache is worn, it shah be well groomed and neatly trimmed at all times in order not to present a ragged appearance. The term "suitably dressed" shall be interpreted to mean the driver, if male, shall wear trousers, shoes and socks, and appropriate outer garments. The female may wear, as an outer garment(s) a shirt with collar, blouse, or sweater together with slacks or skirt, shoes and socks or hose. The following articles of clothing are considered inappropriate and are not permitted when the driver, male or female, is in charge of a licensed cab: T shirts, underwear, tank tops, body shirts, swimwear, jogging suits, or similar types of attire when worn as outer garments together with cut-offs, shorts or trunks. (f) LIGI~NSlHG PROC~DIJRI~. Each applicant for a taxicab or limousine driver's license shall submit an application to the Clerk-Treasurer, along with all required fees and other required items. The application shall require the applicant to obtain and attach thereto a copy of the applicant's limited criminal history, which the applicant shall obtain from the Indiana State Police Department. The Clerk-Treasurer shah forward the application and its attachments to the Carreel Police Department for review. The Clerk-Treasurer shall be empowered to determine, regarding driver's license applicants, whether or not a license shall be issued to an applicant. (Oral. No. D-514, § VIII, C, 5-18-87; Ord.
