The applicant seeks the following development standards variance approval: 4. Docket No. PZ-2021-00171 V UDO section 2.10 Max. 18-ft detached garage height allowed, 21-ft requested. The site is located at 340 1st Ave NW. It is zoned R2/Residence and Old Town Overlay, Character Subarea. Filed by Bart and Tonya Poer, owners. General Info & Analysis: The Petitioner seeks approval to build a detached garage. Its design will complement the existing house’s colors and materials. The proposed accessory building height will be 21-ft, and the maximum allowed is 18-ft. This is a variance of 3 feet, or 17 %. This is to allow for additional usable attic loft space above the detached garage. Please see the Petitioner’s info packet for more detail on the variance request. The UDO’s definition of Building Height is: The vertical distance from the lot ground level to the highest point of the roof for a flat roof, to the deck line of a mansard roof and to the mean height between eaves and ridges for gable, hip and gambrel roofs. So, depending on the slope of the roof, the measurement at the roof peak of an accessory structure could potentially be taller than 18-ft. The proposed measurement to the roof peak is 26.8 feet. The Petitioner addressed all planning/zoning review comments; the Planning Dept. supports the variance request. (The garage also went through SDR review and approval with the building permit application process, for Site Plan & Design review in Old Town.) Findings of Fact: Please refer to the petitioner’s Findings of Facts included in their info packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00171 V, with adoption of the findings of fact submitted by the Petitioner.
