DEPARTMENT REPORT
MONDAY, OCTOBER 25, 2021
(V) LeVert Accessory Structure Variance.
The applicant seeks the following development standards variance approval:
7. Docket No. PZ-2021-00184 V UDO section 2.04 Maximum 18-ft accessory structure
height allowed, 22-ft tall requested. The 6.82-acre site is located at 13120 Six Points Rd. It is zoned
S1/Residence. Filed by Zachary Pinkowski, on behalf of 13120 Six Points Road LLC.
General Info & Analysis:
The Petitioner seeks approval for a 60-ft by 125-ft accessory structure that will house a private indoor
basketball court on a 6.82- acre site, where a home already exists. The structure’s design, colors, and materials
will complement the existing primary residence and additional accessory building. It will be placed at the
northwest corner of the site, furthest away from broth street frontages.
A maximum of 18-ft height is allowed for an accessory structure and 22-ft is proposed. This is a variance of 4
feet, or 22 percent. Please see the Petitioner’s info packet for more detail on the variance request.
The UDO’s definition of Building Height is: The vertical distance from the lot ground level to the highest point
of the roof for a flat roof, to the deck line of a mansard roof and to the mean height between eaves and ridges
for gable, hip and gambrel roofs. So, depending on the slope of the roof, the measurement at the roof peak
could potentially be taller than 18-ft. In this case, the proposed measurement to the roof peak is 28.4 feet.
The Petitioner addressed all planning/zoning review comments; the Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00184
V, with adoption of the findings of fact submitted by the Petitioner.
