DEPARTMENT REPORT
MONDAY, OCTOBER 25, 2021
(V) Nelson Lot Cover Variance.
The applicant seeks the following development standards variance approval for a swimming pool:
9. Docket No. PZ-2021-00186 V UDO Section 2.04 Maximum 35% lot cover allowed, 40%
requested. The site is located at 10422 Windemere Blvd (Windemere Subdivision Lot 77). It is zoned
S1/Residence. Filed by Wayne & Gina Nelson, owners.
General Info & Analysis:
The Petitioner seeks approval for a swimming pool in the back yard. The allowed maximum lot coverage is
35%, and the proposed lot cover is 40%. This is a 5% increase. The pool will not encroach into any easements
or required setbacks. Please see the Petitioner’s info packet for more detail on the variance request.
The Petitioner also has approval from the HOA (Homeowners Association).
The pool will not encroach into any setbacks or easements.
The pool equipment will be located approximately 12-ft from the south property line. The petitioner provided
details on how the noise/vibrations from pool pump equipment will be reduced/mitigated.
The Petitioner addressed all but one of the planning/zoning review comments. The Planning Dept. supports
the variance request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00186
V, and with adoption of the findings of fact submitted by the Petitioner.
