D-1442-99 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ESTABLISHING THE CARMEL HOUSING AUTHORITY WHEREAS, the clearance, re-planning and reconstruction of areas within the City where unsanitary or unsafe housing conditions exist are declared to be a public use and purpose for which public money may be spent and private property may be acquired; and WHEREAS, having previously resolved, in accordance with IC 36-7-18-4(d), that a City housing authority is necessary and in the public interest, and wishing to establish same, NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: 1. The foregoing recitals are fully incorporated herein and made a part hereof. 2. Chapter 6, Article 5, Division VII, Section 6-160 is hereby adopted and made part of the Carmel City Code, and shall read as follows: "Section 6-160. Carreel Housing Authority (a) There is hereby established the Carreel Housing Authority. (b) The Carreel Housing Authority shall have all the powers, rights, privileges, jurisdiction and authority granted, and the duties and limitations imposed, by Indiana Code 36-7-18, as same may be amended from time to time, which Chapter is fully incorporated herein by this reference. (c) All Carmel Housing Authority actions are subject to all applicable City ordinances and regulations, including, but not limited to, those regarding planning, zoning, sanitation and building. (d) The City shall have all the powers necessary or convenient to aid and cooperate with the Carmel Housing Authority, including, but not limited to, those powers set forth in IC 36-7-19. (e) The Common Council estimates that the amount of money necessary for the administrative expenses and overhead of the Carmel Housing Authority during its first year of operation will be Two Hundred Thousand Dollars ($200,000.00). This amount is hereby appropriated to the Carreel Housing Authority out of unappropriated money in the General Fund of the City." 3. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. This Ordinance shall be in full force and effect upon passage and signing by the Mayor and upon such publication as may be required by law.
