HomeMy WebLinkAboutD-1346-97 Emerg.Office Closing Ordinance D - 1346 - 97 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA SETTING WORK AND WAGE GUIDELINES FOR CITY EMPLOYEES IN CASES WHERE THE CITY IS CLOSED DUE TO UNFORESEEN CIRCUMSTANCES WHEREAS, it is occasionally necessary for City offices to be closed due to inclement weather or other unforeseen circumstances; and WHEREAS, it is necessary for certain essential City functions to be carried out even under such circumstances; and WHEREAS, it is necessary for purposes of sound management to standardize the conditions under which City employees are expected to report to work in such situations, and the conditions under which they will be paid. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel as follows: 1. That Chapter 2, Article 3, Division II, Section 2-53, entitled "Emergency Closure Days", is hereby added to the City of Carmel Code of Ordinances, to read as follows: "SECTION 2-53 Emergency Closure Days The Mayor may declare the City to be clo.sed for general business purposes due to weather, special events, or for the general health, safety and welfare of City employees. All City employees shall be designated, by their department heads, as either "essential" or "non-essential". Such designations may change from time to time, depending upon the particular circumstances of each situation. Whenever the Mayor declares the City to be closed for general business purposes due to weather, special events or the general health, safety and welfare of City employees, "essential" employees are expected to report for duty at their regularly scheduled time, or as requested by their supervisors. Failure to do so will result in lost pay for an "essential" employee unless he or she chooses to use accrued vacation time or compensatory time off for the day in question. In addition to receiving their regular daily salary or wage for such a day, those "essential" employees who are working when the emergency is declared, or who report to work for any shift during the emergency, shall be entitled to compensatory time off equal to the number of hours actually worked during the emergency. The Mayor, or department heads designated by the Mayor, will determine when the emergency ends based on information provided by the Street Department, the Police Department and other relevant sources. "Non-essential" employees are not to report to work in such situations unless they are specifically requested to do so by their supervisors, in which case they will be treated as "essential" employees. "Non-essential" employees who are not called in to work shall receive their regular pay for such day. Those "non-essential" employees who, nonetheless, voluntarily report to work on such a day shall not receive any compensation in addition to their regular rate of pay." 2. This Ordinance shall be in full force and effect from and after the date of its passage and signing by the Mayor. 3. All prior Ordinances or parts thereof inconsistent with any provisions of this Ordinance are hereby repealed.
