D-1376-98 Sick Leave Sect 2042Ordinance D- 1376-98 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARIV[EL, INDIANA AMENDING CHAPTER 2, ARTICLE 3, DIVISION II, SECTION 2-42 OF THE CARMEL CITY CODE WHEREAS, Chapter 2, Article 3, Division !I, Section 2-42 of the Carmel City Code ("Section 2-38") deals with sick leave for City employees; and WHEREAS, sick leave is a benefit provided by the City to promote continuity of pay when an employee is unable to work due to a short-term illness, injury or other incapacitation; and WHEREAS, a sick leave policy should provide appropriate incentives for employees to use their leave wisely; and WHEREAS, the City desires to balance and enhance its benefits for employees who are unable to work due to health-related reasons. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: That Chapter 2, Article 3, Division II, Section 2-42 of the Carreel City Code is hereby mended to read as follows: "Full-time City employees shall accrue sick leave at a rate of five (5) hours per calendar month. Sick leave may be taken in quarter hour increments, subject to the following restrictions: (a) Sick leave shall be used only for the employee's own illnesses or doctor appointments. Anyone determined to have taken sick leave for other purposes will be subject to disciplinary action up to and including termination. (b) An employee is to notify his or her supervisor that he or she is taking sick !eave prior to the start of such employee's scheduled shift, except in cases of medical emergency, wherein such notice shall be provided as soon as possible. (C) A doctor's certificate shall be required after three (3) consecutive work days absence, or at any time at the discretion of the employee's department head. Failure to furnish such certificate may result in the employee being prohibited from using accrued sick leave for the absence, and additional discipline, up to and including termination. (d) Sick leave cannot be used in conjunction with disability leave. Payment for sick leave will end when disability pay begins. Up to 40 (7.5 hour) days of unused sick leave may be accumulated and carried over to the next calendar year. Alternatively, accumulated sick leave in excess of 30 (7.5 hour) days as of December 31, 1998 may, at the employee' s option, be converted to vacation leave at a ratio ofthree (3) hours of sick leave to one (1) hour of vacation leave. In the year 1999 and thereat~er, accumulated sick leave in excess of 30 days as of December 31 of a year may be paid out in February of the following year, at a ratio of three (3) hours of sick leave to one (1) hour of pay. During the month of January each year, beginning in January, 1999, an employee who has accrued more than 30 days of sick leave as of December 31 of the previous year shall file with the Clerk-Treasurer's office an election form indicating whether he or she wants the excess hours paid out (or converted to vacation time in 1999). That election shall be binding for that entire calendar year, and such payouts shall be made only once each year. An employee who fails to timely file an election form shall maintain his or her accrued sick time, up to a total of 40 days. Any and all sick leave in excess of 40 days shall automatically be paid out to the employee in February of each year, beginning in February 2000. Unused sick leave shall not be paid out to City employees upon retirement or termination of their employment relationship for any other reason. o This Ordinance shall be in full force and effect on and after the later of December 31, ! 998 or the date of its passage, execution by the Mayor and publication as required by !a~v. o All prior Ordinances or parts thereof inconsistent with any provisions of this Ordinance are hereby repealed as of the effective date of this Ordinance.
