HomeMy WebLinkAboutD-1310-97 Empl PERF AmendOrdinance No. D- 13 10-97 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AMENDING CHAPTER 2, ARTICLE 3, DIVISION II, SECTION 2-48 OF THE CARMEL CITY CODE (AS AMENDED FROM OKIGINAL ORDINANCE D-1310-97) WHEREAS, Chapter 2, Article 3, Division II, Section 2-48 of the Carmel City Code ("Section 2-48") deals with the Public Employees Retirement Fund ("PERF") for City of Cannel ("City") full time employees (with the exception of sworn police and fire personnel); and WHEREAS, Section 2-48 provides that three percent (3%) of gross wages shall be deducted from the salary of each such full time City employee as the employee' s share of PERF contributions; and WHEREAS, the Common Council desires to amend Section 2-48 to read that, beginning on January 1, 1998, City will contribute to PERF an additional sum equivalent to three percent (3%) of each such full time City employee' s gross wages to PERF, in lieu of that employee' s own three percent (3%) of gross wages contribution to PERF. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel as follows: That Chapter 2, Article 3, Division II, Section 2-48 of the Carrnel City Code is hereby amended to read as follows: "All full time employees (with the exception of swom police and fire personnel) who work or expect to work one thousand (1000) hours or more per year must join the Public Employees Retirement Fund (PERF) on the first day of hire. Effective through December 31, 1997, three percent (3%) of the gross wages of each such employee shall be deducted from that employee's salary as that employee's PERF contribution. bo Effective on and after January 1, 1998, an amount equal to three percent (3%) of the gross wages of each such employee shall be contributed to the PERF by the City in lieu of such employee' s own three percent (3%) of gross wages PERF contribution. Those PERF contributions, if any, that are made by an employee through a salary deduction pursuant to subsection "a" or those made by the City pursuant to subsection "b" of this paragraph may be refunded to that employee upon termination of such employee' s employment with the City and application to the PERF. The City Attorney is declared to be covered by the PERF." All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. o This Ordinance shall be in full force and effect from and after the date of its passage and signing by the Mayor.
