HomeMy WebLinkAboutD-1290-97 Empl Benfits AmendOrdinance No. D-1290-97 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AMENDING CHAPTER 2, ARTICLE 3, DIVISION II OF THE CARMEL CITY CODE WHEREAS, Carmel City Code Chapter 2, Article 3, Division II (the "Division") sets forth the provisions regarding the Employee Fringe Benefit Program for the City of Carmel; and WHEREAS, certain Sections of the Division are duplicative, ambiguous or obsolete. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: o Chapter 2, Article 3, Division II, Sections 2-40 and 2-53 of the Carmel City Code are hereby repealed; and ° Chapter 2, Article 3, Division II, Section 2-55 of the Carmel City Code shall be amended to read as follows: "The benefit programs addressed in Sections 2-41 through 2-49, and Sections 2-51 through 2-54 do not apply to sworn police and fire personnel, who shall be governed by their respective rules and regulations." o This Ordinance shall be in full force and effect from and after the date of its passage and signing by the Mayor. 4. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. The first amendment, which includes several minor changes, is on the agenda for April 21. A copy of the amendment ordinance (D- 1290-97) is attached and a brief discussion of the changes follows. Because Sections 2-40 ahd 2-55 are essentially duplicative, and Section 2-55 is the more accurate of the two, Section 2-40 is repealed. Section 2-55 is revised to change the word "regular" to "sworn" because the word "regular" is ambiguous in this context. Since ~anuary 1, 1)97, civilian police and fire employees are under City Code rather than departmental rules and regulations, and tNs change makes the distinction clearer. Section 2-53 is also repealed because it has been replaced by another program that serves the same purpose. In 1990 the City created the Catastrophic Medical Leave Bank, which is a more formal and well-defined plan for sharing sick time with co-workers in need of additional time (see Division iV, Sections 2-66 through 2-71). I expect little or no employee reaction to these changes, as they will have minimal impact. I will, however, notify employees and give them an opportunity to respond.
